Thread regarding Hewlett Packard Enterprise (HPE) layoffs

Question regarding the layoff notice in HPE

I got 2 weeks notice only on April 8 and I was told - you don’t need to work in the following 2 weeks and your last day in HPE is April 19 and then layoff package starts for 11 weeks, I have no chance using my vacation PTO , Is this illegal?

HPE is not a nice one for sure, only 2 weeks notice and then starts the severance package immediately, that package is 11 week pay. It is a joke that HPE is on the list of the best companies work for in USA.

you got 2 weeks chance to use your PTO. And with the way HPE calculates it, you could only have 2 weeks in their eyes by April

If you are in California, it is illegal. If you received a severance and signed the paperwork to receive the severance, then you forfeited your right to sue HPE and the severance received basically compensates for vacation lost or things like that. Companies aren't required to give severance.

The 60-day rule for layoffs
Employers must give a WARN notice at least 60 calendar days before any planned plant closure or mass layoff. If all employees are not terminated on the same date, the date of the first individual termination within a 30-day or 90-day period starts the 60-day notice requirement.
