Restrictive covenant agreements are not enforceable

The incentive plan acknowledgement that teammates have to acknowledge in Workday is not legally enforceable. If you leave after AIP is paid and LTI vests and “recruit” teammates to join you, Truist has no legal recourse as long as you adhere to the below -

  1. Limit all communication between you and the teammate to verbal communication on the phone. Never put anything in writing. That means no emails, LinkedIn communication or text messages.
  1. Have the teammate apply online to your company just like any other candidate. Truist cannot sue you as this candidate is qualified for the job and applied online just like anyone else.

Do not be intimidated by this garbage Truist tries to pull. Executive Leadership knows talent is leaving Truist in droves and they are panicking. Truist won’t be around in 2025, as will be acquired by a larger bank!

As long as the Truist employee initiates the conversation, Truist has no recourse. They cannot actively hinder someone from working.
