Layoff and Disability

Non-remote but non-core location team member here. We were told that we would be displaced however I have scheduled surgery and will be off for at least 3 months. Anyone been in my situation and know how this will impact severance? I don’t have much only been at WF 8 years. But don’t want them to just term me either.

I was on disability leave when I got my displacement letter. A few things I learned: the 60 day notice period doesn’t begin until you ‘return’ or come off disability leave. So you need to go on disability before you get laid off. Severance is standard +60 days, and this mean is you go out of leave prior to displacement, you’ll have your 8 weeks on disability, 8 weeks of ‘notice’ and severance for 16+ weeks. Sounds like a good deal to heal. Get in for surgery right away!

severance is determined by years of service. 2 wks for every year, plus 60 days notice (90 in some states). Being on leave doesn't impact that.

If the timing of the layoff is while you are out for surgery, then you will be notified while on leave, but the 60 days doesn't begin until you return from your leave.

Being out on disability does not protect you from a layoff as long as the company can document that you would have been laid off regardless and that it was not related to your medical condition.
