Overpaid severance bonus, asking for pay back

I got PIPed early this year and got my severance package, which included a severance bonus. The document I signed only mentioned that the bonus will be a pro-rated amount, no actual figures given. Today, I got a letter saying they made a clerical error and asked me to return $9k. WTF? I have no problem returning it since it is not mine, but a bank can't even handle payment correctly? It also leaves a bad taste to ask for money back after putting me in financial hardship without a job. Fu-k Capital One

I received a similar letter today. I'm definitely not going to pay them anything back.

OP here. My severance package is the standard 12 weeks pay + unspecified amount of pro-rated severance bonus. I received over 10k after tax for the bonus. Now they are asking for $9k back. They did not explain how the bonus is calculated, so I don't know how much I'm supposed to get. Even now, how can I be sure that the 9k they are asking for is accurate?
The whole episode feels so unprofessional. They expect me to hand over 9k without a single explanation of the mistake. I will wait for the second letter and challenge them to prove that I was overpaid.
They lost me as a customer as well. I'm canceling my credit cards and closing my bank account.

What did the severance package have as the amount? If it had the 9k included, then that would justify it.

How would they justify that they overpaid you? They wouldn’t provide my severance amount with bonus, only a month range and a prorated bonus.

OP… How interesting! I was also PIP’d earlier this year and chose to opt out for a severance package. Just received a letter today that I was overpaid for PTO by almost $4k! And if I don’t pay it back I can’t work there again, which I’m not eligible for anyway! This all seems very suspicious! I received my severance check for 12 weeks pay, minus taxes. A separate check for my last few days which was a few hundred dollars, another separate check for PTO which was also a few hundred dollars (which seemed too low). If all they can do is not let you work there again, f*ck them, since we aren’t eligible for rehire anyway after being PIP’d and terminated. I wonder how many other people received these letters and how many people will send the “overpayment” back. What a bunch of evil crooks they are!

I wonder if Capital One will send it to debt collectors. They are a bank and should be good at collecting debt. But I'm certain there will be follow up letters before they do that, so hang on to the money a little while and see if that happens.

I would put the money in a seperate account. Close the account the money was deposited to, if it was done electronically, and wait for a demand letter from their attorney.

I am betting the letter never comes.

I’d keep it - unless the demands escalate they are probably just hopeful a few people send it back - they might not have any recourse if you hold onto it
