Noncompete enforced, really?

Anyone else get notified their noncompete is being enforced? Saying I have to tell them where I take a job. Realize they are just about unenforceable but WTH?

They have to pay you if they enforce it, given this job market it might be a better option.

Nike should have notified NCA folks either way if they will void the agreement or if they are keeping ex. LT or executive making greater than $151k. I have a NCA and I heard nothing about them voiding it when the filing is complete. And yes the filing could be delayed there are 3 parties interested in challenging the ruling. There is alot of info out there about the ruling and status.

If you haven't heard that they will enforce your non-compete by now, then you likely are not affected. Most people heard this week or last.

wouldn't sweat the NC at all; I know folks counting the hours (residing outside of California). Only if you were ELT would there be a question/negotiation. The national non-compete ruling goes into effect in like 90 days...if you have any fear, just don't update LI for a while to save your sanity - also you'll have support once it kicks in. The final rule will become effective 120 days after publication in the Federal Register.Once the rule is effective, market participants can report information about a suspected violation of the rule to the Bureau of Competition by emailing noncompete@ftc.gov. https://www.ftc.gov/news-events/news/press-releases/2024/04/ftc-announces-rule-banning-noncompetes

non-compete ban doesn't take effect for months from now, and it isn't retroactive for certain higher level / strategic positions. It's also highly likely to be challenged in court which will pause it going into effect.
