I live in NE and go the ax for failing to drive in 58 miles each day 4 days a week. I did get 14 weeks severance, can i file unemployment? I keep hearing different things, and it is very hard to talk to anyone from the state. What about all you Sioux falls folks where your whole site closed earlier this year? Could you file. I know we obviously got a lump sum payment, well after a huge tax bite, but this is not continuing payments. does anyone know for sure, do i have to wait until after severence runs out or does that not matter since really, they paid me to not sue them and not through a certain date.?

The reasoning I've seen for filing right away vs waiting is they look at your income for x amount of weeks before you file to determine what benefits you would receive if approved. If you wait to file, that severance does NOT count as income, so your unemployment benefits would be calculated using many weeks of zero income, leaving you will very little in unemployment benefits.
Expanding on the Nebraska reply…During your 14 weeks of severance, the expectation is that you’re searching for another job. Should you still be unemployed after severance runs out you can the n collect unemployment in Nebraska provided you actively look for work during that timeframe. You will be required to apply for 5 jobs per week and detail those in their online tool.
For those that were laid off, how long did it take to receive your severance? I was recently laid off and heard it could take awhile.
Nebraska won’t pay until your severance runs out.
I wrote that wrong. In Florida, you need to file on the Monday after your last day. You will send in your job search after two weeks, and get paid for one. After that, you will get paid every two weeks, until the last one, which is one week to make up for the first one.
Amazing all the hiring in NE for the sacred tax advantages…I would hope you get unemployment!
We have one former employee in Alpharetta who was driving 92 miles to work one way. He resigned and is going to a competitor. The Fiserv stupidity at the executive leadership level caused this.
Check your state law. In Florida, we could file two weeks after final date, with the first week -permanently- withheld. We got all 12 weeks unemployment after filing 13 weeks. Again, in this state, because severance was a lump sum, it didn't impact unemployment.
Pro tip - you get a huge tax bite because taxes were deducted from that final severance check as if it was a normal paycheck, and that put you in the highest bracket. When you file your taxes, the IRS will consider it just more earnings for the year. I got a bunch back. It was actually to the penny what I calculated I'd get back from the tax rate tables.
File right away, if they say no, they should provide a reason, then you'll know for sure.
Agreed, it varies by state.
You’ll need to check with your state law. In my state, we were able to file the day after our final date.
