Thread regarding Fiserv Inc. layoffs

Required 7 hours a day of online clicking on PC

Fiserv needs to decide if we are hourly employees or salary employees.
Hourly get paid OT, Salary do not.

If we are salary, then the following rule taken the government labor laws website - "an exempt employee must receive the full salary for any week in which the employee performs any work without regard to the number of days or hours worked."

I do not think it is legal or ethical for Fiserv demand how many hours a day you must be actively clicking on your computer or sitting at your desk. Anyone know a good labor layer?

  1. 602 Salary basis.

(a) General rule. An employee will be considered to be paid on a “salary basis” within the meaning of this part if the employee regularly receives each pay period on a weekly, or less frequent basis, a predetermined amount constituting all or part of the employee's compensation, which amount is not subject to reduction because of variations in the quality or quantity of the work performed.

(1) Subject to the exceptions provided in paragraph (b) of this section, an exempt employee must receive the full salary for any week in which the employee performs any work without regard to the number of days or hours worked. Exempt employees need not be paid for any workweek in which they perform no work.

So FB wants collaboration by RTO but you can’t leave your desk because you lose key clicks. So you have to collaborate with others on teams anyway. Way to go genius

I’m not sure I would take advice from someone who can’t spell labor lawyer correctly. Why don’t you go talk to an hourly employee and see how much you make vs them. You might want to rethink your comments. Rookie.

Remember when FB scoffed at the idea that Fiserv didn't offer employees "flexibility" - just like everything he says, wait long enough and he will prove himself a liar!

Fiserv is rapidly transforming into a modern day sweat shop all on account of FB's greed!

Ibm got sued several years ago for similar and they lost or settled. My husband got a big check for back overtime he would have earned.

Please, some file a class action! I will sign up!

Many right to work states are setup in such a way that they can legally demand you work 24 hrs a day, 7 days a week and your only recourse as an employess is to quit.
