Thread regarding Capital One layoffs

Can you get unemployment if laid off?

I’ve heard conflicting info about whether or not you can file for unemployment if you are laid off. Anyone know the real story? Can you only get it if it’s job elimination or if it’s “performance” related too and you’re on a CP or PIP? Also, is the severance package different between Job elimination and performance layoffs?

Do you receive the severance pay in 1 lump sum?
Or over the 12 weeks?

Apply now. The weeks you get your severance checks, report them as income on your unemployment. You get any benefits those weeks but it will resume the following

In my state you can always file unemployment, just that during weeks where an income is incurred, it is reduced or $0. You still file every week and the check continues on weeks with no income.

Yes. I would wait until after severance ends to file, though. Definitely eligible to file for U/e.

Yes, for example if you get your package money on Jan 15, wait till February, and you will get your unemployment payment

You can start your unemployment application the next day when your unemployment ends. So if you're on redeployment for 2 months you are still considered employed. The day after the 2 months you can file unemployment and it should retroactively be applied to your first day of being unemployed. Google unemployment for your state and look at the FAQS and now applications are submitted online. Being fired on a PIP you can claim unemployment too. You continue to apply period.
