Class action lawsuit for discrimination

Hi everyone, I figured I would get the discussion going now before it is too late. I have been considering filing a lawsuit against Enbridge for the discrimination of these layoffs that was brought to light with yesterday’s email that stated “we’ve moved the needle from 3% proportional Black representation to 3.5% toward our goal of 6% by 2025.” I am all for equal representation and almost overlooked this email but then it occurred to me that the said email that came out exactly one week after announcing 650 positions are being removed for unspecific reasons is blatant evidence of corporate discrimination against all employees that aren’t black. Please do not disrespect our black coworkers or post any offensive language but consider these two emails with a calm and logical mind. What if the word “Black” was replaced with “White?” Anyway, I don’t think it would be just if I file suit on my own and leave 649 other people to be wrongfully terminated. Let’s get the conversation going and if we have any lawyers on here that want to help guide us in a suit or connect us with an appropriate law firm, that would be much appreciated. I know there is a tight timeline for filing a suit like this.

Race has no place when it comes to our livelihoods. Please continue to respect all colors and help me right this wrong before it happens.

This is seriously insane! I know for a fact Enbridge has been on a DEI crusade, and have been trying to get rid of white employees for a few years now.
Over 90% of their IT is "offshore" workers from India...But since they're all contractors; they don't count toward their diversity goals.
Any full time positions that come up they outright refuse to entertain white males, not even joking.

If a white employee applies they'll be told on the side that they already "have a candidate in mind", or they have a "hiring freeze"...but still end up hiring the diverse candidate behind the scenes, or "you're just not the success story were looking for" etc.
I've personally seen this happen half a dozen times and had people complain to me because they couldn't believe they didn't even have the chance to interview.

Since manager bonuses (STIP) have a clause of adding 3-5% more "diversity" AKA non-white employees per year... And since only full-time employees (not contractors) count toward those numbers...The only way to reach those quotas are to lay off internal, white employees in favour of non-white. The alternative is the managers take a 30% hit on their bonus... Which they won't let happen.

I say you should sue their as--s off!

Lots of noise in here but few good points listed.

Fact is Enb said they aren’t competitive and need to lay off 650 people. They haven’t even done this yet and at the same time they said they need 3-400 more staff. The company isn’t expanding and where do those 3-400 people work. In the roles vacated by the 650.

Remember that we're bringing on thousands of new people with the acquisition, so who knows what the #s will look like by the end of 2025. The idea that cutting 5% in Feb 2024 to achieve a certain demographic by Dec 2025 is stupid.

So you’re assuming that this layoff is about balancing the races and has nothing to do with actually boosting the stock price, overall company cost reduction. Makes total sense for sure :/

No need to turn on each other. Everyone is facing undue harm from impending layoffs. Everyone here likely agrees on fairness for all.

The issue is that it is illegal to layoff 5% of your workforce in an attempt to boost your workforce percentage of a single race. This is a fact and it is a law. This would also be an impossible court case if Enbridge had not released the two emails within a week of each other. This is another fact, Enbridge announced a goal of increasing black representation from 3.5% to 6% by 2025 while they are actively laying off around 5% of the workforce by March of 2024. Nobody has an issue with 6% or even more black representation. The issue is that it is illegal to fire people to get those numbers. In an attempt to boost diversity, Enbridge has created an environment of discrimination and it is turning people against each other.

The main point of this thread is not that X minority group is being favored, it's that the company is deliberately targeting Whites for less representation, i.e discrimination.

and please stop with the "muh united we stand divided we fall" bullsh-t. the company is now financially incentivizing less White people, functionally phasing them out of the hiring process in some cases.

why don't you try uniting around that?

Sorry but I find this discrimination post funny. I don’t know which office you’re working at but from what I see Enbridge folks are a lot of Asians, Africans, South American with a mix of all colours and race. One of the white person I used to work said “we are the minority here”.

consider me on board. even if it goes nowhere, you'll be able to find out through discovery the demographic information of the 650 that were released.

company fu---d up big time once they made "D. I. E." part of the new STIP metric. now it can be said that the company is financially incentivizing the act of avoiding hiring White people. I don't care how small. it's still there on paper.

even better, the company will be have out and basically say that "diversity" is just a code word for less White people, which is the definition of discrimination. it's one thing for the company to do all the mealy mouthed kind words BS about D.I.E- we all can just tune it out and go back to knowing who is really out there in the field keeping things running. now by compensating all of us based on how much we actively exclude Whites from the hiring process they have made a big mistake.

I'm with you 100% OP. At the least this BS gets called out and a couple news articles get written. at most, you have something that results in case law.

Also, if half of laid off employees are black then it would be discrimination against them.

Corporate Enbridge messed up and they can’t undo the fact that they sent these two emails with very specific numbers within 1 week of each other. Please do not allow the dialogue to become black people vs everyone else as this is the narrative that supports Corporate Enbridge and not the 650 employees to be laid off. Also, please don’t think Corporate Enbridge is foolish enough not to layoff a handful of black people in an attempt to disguise this discrimination. In any scenario, black and non-black people are intended to be discriminated against and let go in an attempt to increase black representation and push a narrative that has nothing to do with operating a safe and profitable company.

There are many legal precedents for this case but unfortunately most of the ones I have found only apply to wealthy executives who have much higher salaries and payouts for a civil case such as this. The facts are that within 1 week Enbridge announced an impending 5% reduction of total employees and goal to increase black employees by 2.5% of total employees and that both scenarios are intended to happen within a year. This is not an emotional case or case of privileged race but it is simple logic and math that is not in compliance with all of our civil rights.
