Thread regarding Truist Bank layoffs

Disability / EEOC lawsuit

Anyone here ever experienced an employee with an ADA protected disability filing a EEOC lawsuit against Truist (or any of the heritage banks) for wrongful termination or employment discrimination? Curious if Truist settled and how much the settlement was. I have heard it is nearly impossible to fire an employee with an ADA protected disability as invariably the employee will sue.

Thoughts?

@jih+1qVGaJDE - That is true that someone that belongs to a federally protected group can get RIFed or fired just like anyone else, there are legitimate reasons the terminated employee can file a charge with the EEOC and then file a lawsuit in federal court. That is why it is so important to document everything. Even the slightest instance of malfeasance on say the manager’s part, the teammate can postulate that they were terminated due to their disability, that the teammate’s manager retaliated against them and get a nice sized settlement (upwards of hundreds of thousands of dollars).

No true about firing. If a ADA protected employee is in a LOB that is going thru RIF they can get riffed just like anyone else in the department. they are not exempt just because they have an accomadation.
