Does 11/9 RIF Meet the WARN 60 Day Notice?

You do the math. 11/9 to 12/29 doesn't equal 60 Days as required by the WARN Act.

VZ does RIF year round for decades. Do you not think they and their overpaid lawyers know the laws and follow them whether it is unethical or not ?

I have a friend at AT&T and they use to get 60 days for management and that was changed to 2 weeks last year. The union rep employees get 90 days.

WARN isn't required to be filed in advance if employees are given more than. 60 days notice, 60 days severance, or a combination of both. It only deeds to be filed before their last day.

I think you all better read up on the WARN act. In most cases, the RIFs don't meet the criteria for requiring one. In states with a 60 day notice, they meet that with the 30 days notice and a minimum of 30 days severance + job search assistance. But in most cases, they never lay off more than 49 regular full time employees in any one location anyway, so it wouldn't trigger a WARN. For those stating age discrimination, the company is required to provide a report when there are employees over the age of 40 which details the title, band and count by age of the employees selected and retained for the RIF. You should have that documentation as part of your severance package if it applies.

Believe me people, the company has good lawyers. Move on and find a better job.

Its 90 days in NY if a WARN was required. VZ hasn’t done one in the last few years per https://dol.ny.gov/warn-notices so they must know how to avoid needing one.

I am in NY and I am off the books on Dec. 29. My laid off notice was given on Nov. 9 which is 50 before my last day. Do I have a case?

If you download the org chart, it should show the that the majority of VZ “management level” employees are Indian. But <1% (if any) of those RIFd were Indian. Join/work together and sue.

If RIF’s being used as backhanded way to get rid of older employees and replace a few months later with younger ones with lower pay, a class action lawsuit should expose such practices by getting that truth(age & salary or employees let go, rehire timelines, etc) - and companies made to pay thru lawsuits if discriminating in any way.

it does but the company does not need to file immediately, many are off the book on Jan 10 but those who are in states with 90 days like NJ and NY are off the books on Feb 10
