Employees in Virginia. You can legally your conversations with your boss without their knowledge. Virginia’s wiretapping laws state that only one person has to consent in a two person conversation. You do not have to ask for your boss’s consent because you’re the consenting party.

What cases are you referencing? That seems surprising as the types of recordings being discussed here are likely protected under the NLRA. And that is without considering the one party consent element. Even an employer in an “all party” consent jurisdiction would face an uphill battle if the recording was related to a non-frivolous grievance, concern for retaliation, illegal activity, etc.
Strongly advise against this. Courts have repeatedly ruled against employees that have brought suit based upon secret recordings.
North Carolina is also a one party consent state.
