Ageism is real

Discrimination therefore is real

Companies try to have diversity in race.

You could be black or white and get discriminated against as I’ve experienced it as a white woman where black have replaced me for company numbers showing diversity in race

Gender discrimination is real as well where single individuals get replaced more than males

ELV knows what they're doing and they have the full force of internal and external legal behind them before they proceed with RIFs.

Though RIFs indeed tend to target the older and the non-white in my experience, they RIF just enough younger white people that even when there's a potential case, attorneys won't take it because the org has created plausible deniability. I've seen up close two people experience this, people who were CLEARLY targeted and had been for months prior to RIF, but multiple attorneys turned them down after investigating when the org could prove they also RIF'd others outside protected classes.

I wouldn't hold my breath for a class action.

The more people stand up and exercise their rights. The more companies need to change or adhere to employment law, which they do not

The RIFS are disguised — they are employment discrimination usu age

As another post mentioned often due to mistakes of higher ups, who are there to keep their jobs and abuse their authority at any cost for self preservation

Employees pay for poor management.

Just FYI far and wide people and companies have heard about the horrific and age related layoffs/RIFS at this corporate greedy giant who steals from the poor and gives to the rich. I have interviewed with companies outside of healthcare and word on the street is that EH really f*ked people over and broke a number of "legalities," that of course I won't go into, as they truly are above the law - well because giants like this always are. Thought it was funny though that so many varied companies had sympathy for me as a job seeker who was employed by these immoralists.

I have been through what you are going through almost 10 years ago. Its just best to move on. Believe me. You wont miss them once you make the next leap in your life. Difficult days may be ahead but hang in there and you will preserve .

Good luck. I was RIFd for ageism along with a slew of others in the same category. Still, no chance and all a lawsuit will do is cost you time and A LOT of money. For what? You signed an agreement that you're an "at-will" employee.

Move on. You're better off.

Who said anything about discrimination and H1b visas? I am telling you, i've read the trial transcripts of multiple discrimination lawsuits Anthem has been involved with. One was posted on this site, it involved 2 women sued after being RIFd and they were in their 60s.

They both lost. There have been countless others.

Sounds like the corporate attorney in the response - a tactic so you will not pursue your rights.

The more people stand up for their rights. The more corporate has to change their illegal tactics, and become more compliant to employment law.

Why do you think you have grounds for a lawsuit? You are not entitled to a job they are within their right to manage the workforce the way they see fit. I recommend you run some searches on this site or google and you will find cases where EH went to court and they won.

There have been plenty of lawsuits over RIFS and they will bankrupt you in legal fees and you will not win. Also, when you sign off on your severance you are agreeing not to sue.

Pull your pants and move on. Is this a good use of your time?

Anyone can be sued. The question is, will it be a winnable lawsuit. Also, most companies will not go to court, they will settle before that.
