Thread regarding JPMorgan Chase & Co. layoffs

A FMLA Q

So, my wife's been working over at JPMorgan, and guess what? We've got a baby on the way! She'd planned to kick off her FMLA leave by the end of this month and even went ahead and applied for it. But here's the kicker - she found out today that they've gone and eliminated her position, and she's got just 45 days left with the company.

Now, I've heard some chatter about FMLA protecting folks from getting the boot, but I'm not exactly sure if that applies here because it seems like they axed the whole team. Any of you fine folks got any advice on what my wife can do in this mess?

Post ID: @2qym+1oKOw9Ln FMLA is Not unpaid leave. It's short-term medical leave and most health insurance plans pay 60% of your base salary when you're on short-term leave. This is assuming the employee filed the appropriate documents and claim form with the insurance carrier.

FMLA doesn't keep you from being laid off. you can even be laid off while you are out on FMLA - all FMLA does is delay the formal termination/notice period until you return.

They can eliminate her position or her team. If they say its not related to performance, but this job is being eliminated, then FMLA doesn't protect her.

Who said NY gets 90 Days???? Friends laid off in NYC got 45 Days. When they disputed were told it depends on the department/division.

The good news is Mama can focus on the baby. Consider it a blessing and a time for her to bond with the newborn. After 6 months or sooner if she wants, she can go back and look for some new positions elsewhere.

Why not post what segment of the bank she is in? It helps to add little facts and context to your story. Then people can understand it better.

Why does she not have a 60 day notice period? That's required in every state when there is a mass layoff; however, NY gets 90 days.

During the notice period, she is still considered an employee, so should be able to take her leave as benefits would be the same. With the baby on the way, why would she just not take the paid 16 weeks paid maternity leave benefit? She would be able to take the leave, get paid and then her severance would kick in after. That would give an additional four months of paid leave. FMLA is unpaid leave and offers no protection during a mass layoff/position elimination.

If she was on FMLA when the layoffs happened then she wouldn’t be laid off however, if she was on the list of layoffs on her return from FMLA leave they would’ve laid her off upon return.

If they eliminated the whole team she won't have much recourse. Fmla can help to save you when some are being laid off. If they can justify by saying the whole department is gone... not much you can do. So sorry. But congrats on the most important part. May your baby be healthy and happy
