Can I get my unvested stock back

I have earned it as a bonus in prior years. No other company does this nonsense. Any idea how to get it back.

If you get job offer before you get severed you can negotiate a signing bonus to recoup the value of the unvested RSUs you would lose. You can always try this after a RIF, but you kind lose the negotiating leverage when the new employer knows you're currently out of work.

I lost ~30K when they closed the Houston office in 2018. Heck I lost my severance as well as they converted me to a contractor. Best thing they did as it forced me to find a way better paying job with a much better competitor.

I left in 2022 with a severance because I did not want to relocate (I was remote). They “accelerated” the vesting on the shares that would have vested in the next 12 months. I lost the other unvested RSUs.

Can I just "promise" to do work I was hired for over the next three years, but still get paid for it now? What's good for the goose...

Of course if I leave I won't have to provide that work, but I still get to keep the money, that's fair according to fiserv... right?!?

According to the docs you e-signed when you accepted the RSUs, if you're layed off, you might be eligible to have those RSUs vest, but if you're fired or quit, you lose them.

IANAA, but you might want to read those docs (available on the Fidelity site if you dig around enough) and maybe have a labor attorney look at them.

It's weaselly that our "bonus" for hard work already performed is withheld for three years, and then lost if you move on... it's almost like they like effing us over.

You lose it in a layoff if it didn't vest. And a lot of big companies use the structure but those companies legitimately want to retain talent.
