Thread regarding Capital One layoffs

pure evil - no unemployment WARN (Worker Adjustment and Retraining Notification) notices cuz - STACK RANKINGS!!!

Based on speaking with internal teams directly in person about major layoffs and looking at this website. Why isn't this in the news?

There are no WARN (Worker Adjustment and Retraining Notification) notices because that is for employees who are actually laid off. I searched VA, CA, and TX and IL and found no WARN notices. That's why it's not on the news.

They're firing people based on stack rankings / force rankings / rank and yank made during mid-year performance management calibrations in April, May and June. Firings based on performance are not required to be reported with WARN notices. So they intentionally made up lies during performance management and put people on PIPs and firing them. No company has to give any severance to begin with, but getting fired for performance is means you can't or shouldn't file for unemployment insurance. So you file for unemployment anyways and if they fight it accuse Capone of misconduct.

The stack rankings have already created a race war amongst employees.

And we know it's because they want to cut costs without having to pay jack s**t. It all makes sense now.

To the last poster its true. You have an option to take the PIP and be guaranteed to fail and be fired. Or directly take a severance and be fired immediately.

NEVER SIGN A PIP. ALWAYS DEMAND A SEVERANCE AND BE FIRED.

I’m not sure if this is still true, but I’m a former UM in the FDO LOB and you were able to “opt out” of the PIP and get paid for those 60 days without having to work a few years back. You lose your job at the end, but sounds like the toxic environment hasn’t changed so definitely worth it.

They get around needing WARN notices by offering severance for at least the length the WARN notice would cover (most states it's 60 days). Also WARN has a threshold of % laid off before it is required. Basically if they are not laying off more than 1/3 of a single site, there isn't a notice required.

Capital One’s expensive attorney has to attend the unemployment dispute call. File for unemployment if you are let go and force them to attend. If enough do it, they won’t be able to.

If you are fired for cause you can't get unemployment. This means if they say you're doing a bad job that is cause for termination. You should apply anyways and if capone fights it then you accuse them of wrongful termination for se-ual harassment, racial harassment or anything else.

Can Capital One say, lay off 100 people every week, to avoid filing WARN? I feel like WARN notices should definitely be filed with the recent layoffs but have not seen any.
