I saw an attorney today and I have a case!!!! All the jargon in the severance package is BS and not enforceable by law. Attorney said they will settle without trial as they know a jury will never side with them. Of course all their scandals help people to feel tainted by the name. They also can’t stop us from going to the media reporting their laying off older people in a protected class.
If you are 40 or older, you cannot legally be required to sign anything on the day of your layoff, regardless of what HR tells you. And if you do, it is not immediately binding and can be "unsigned". You have at least 21 days, and potentially up to 45 days, to sign something.
If you are over 40, the first thing you should do after getting laid off is take a deep breath. Then, call an employment attorney. It's worth getting some advice from them. Maybe you have a case, maybe you don't. If it's on contingency, you pay nothing upfront and they take a cut of your settlement.
Hahaa! They couldn't lay off the entirely clueless and useless 72 YO on my team, so they kicked other far more competent people to the curb. Yes, really.
This thread is in ironically why the job market is tough for older people. If you hire them you cannot get rid of them without being sued.

I Have called an attorney who is taking my case. That severance BS you sign does not have any credence like they want us to believe. Can’t wait for the tables to turn. They think they can bully you. Guess again!
I have a friend who was laid off from a lawyered-up global brewing co at age 50. She sued for age discrimination and won a 7-figure settlement. (Her husband was still working.)
Wells Fargo’s Achilles Heel is they are brazenly arrogant, have respect for no one, and they think they are smartest guys in the room. They love to push the limits of the law and break rules, and they get away with it until someone sues them.
Wells Fargo loses lawsuits all the time. Why? Because The Boys Club, at heart, are a bunch of entitled rich kids who think they are better than everyone else. They don’t think the average employee, customer or shareholder are smart enough to figure out Wells Fargo’s entire business model is based on skirting ethical and legal boundaries. You, the lowly commoner, should be grateful for your measly severance and quietly go away.
Sue the he-l out of them if you have any hint that your age (or any other protected class) was a factor in losing your job.
Wells isn't youthful to begin with, I'm in my 40's and the youngest on my team by quite a few years. It isn't uncommon to hear people with 30+ years of service.
This isn't an excuse for everything that has been going on, just thinking the numbers play out where older workers are greater in quantity.

Any true labor lawyer can get past a mixed layoff. They just need to find someone with less time with the bank and the same performance rating as you, doing the same job. These lawsuits almost always lead to quick and quiet settlements. Mine was settled last year in 2 months with adding a full year additional severance. I paid my attorney $15k. The document they make you sign saying you won't sue has been litigated in many states in favor of the employee. You signed it under duress, so it is not valid. The bank knows that but gets you to sign anyway. Some will never sue thinking they can't.
