Thread regarding Centene Corp. layoffs

VSP & OWBPA for employees over 40

Does anyone know how & when the OWBPA (Older Workers Benefit Protection Act) will come into effect for employees over 40? Before making any decision, I want to clearly understand:

  • The specific rights of employees over the age of 40
  • The consideration period (typically 45 days)
  • The revocation period (typically 7 days)
  • Whether an age disclosure list will be provided & when
  • What happens if I decline to sign the release after acceptance.

Please do not confuse these questions with the timeframe we’ve been quoted to apply for the VSP.

Don't leave something this important up to a message board that could be wrong. Ask for a free employment lawyer consultation - maybe see if EEOC or a local attorney might know more about timeframes. Also call and talk to the VSP ppl directly on when final separation docs would be signed

I would encourage everyone to take out time to reas things for yourself. The OWPA does not protect you layoff or voulntary separation and in some cases termination. OWBP) is a 1990 federal amendment to the Age Discrimination in Employment Act (ADEA). It protects workers aged 40 and older from age-based discrimination regarding employee benefits (like health or life insurance) and establishes strict requirements for severance agreements and waivers. They can not withhold giving you the VSP based on your age. More information can be found on department of labor website as well as state labor law websites.

@OP The 45-day period applies to reviewing and signing the FINAL Separation Agreement/Release not applying for the VSP. So my question is if our application is accepted, when will that agreement be provided?

If you submit the application for VSP you have told the company you are willing to resign. After July 2, you can’t take it back if they approve it.

That’s it. Your age doesn’t matter. This isn’t part of the involuntary layoff.

You told them you’re willing to voluntarily resign. You’ll be given a separation date. The end.
