Class Action Lawsuit?

Verizon Wireless Delayed 401k payments during off cycle paychecks.

This mostly happened during off cycle commission checks.

It’s a small amount to the person getting it but adds up to a lot when combined with everyone’s payout.

The scheme falls under the ability to fund a 401k within 15 days.

The rule is usually reserved for small companies but was used b Verizon.

A payout is supposed to be made as soon as administratively possible.

It’s called 401k float under some lawsuits. Some call it self dealing.

It’s already cost some companies millions to settle.

Typically a company that has done this has faced a class action lawsuit.

So it seams it have happened since the company had off cycle commission checks.

Effects many employees.

For example it happened in 2020 for the months of April, May , and June for at least Indirect, they had a quarterly commission check due the last Friday in July a off cycle check.

The commission was payed on the last Friday in July.

The 401K funds from the commission were payed along with the August pay out on the August 7th pay-date.

This was a normal thing it occurred this way with commissions with every off cycle paycheck.

Float is the 7 days of the 401k payment that was not deposited and was in limbo for the 7 days.

Combined with the weekly payout.

Those of you with Fidelity 401k can check this easily.

Just not a lot of people notice it.

It more likely effects older employees

That got OFfCYLYCE commission checks the 401k payout was delayed till the regular paycheck.

It was classic as it happened typically during a when a dividend payout was due as well.

Like when a lot of people were moved to Quarterly commission payouts.
