Thread regarding Oracle Corp. layoffs

Worker Adjustment and Retraining Notification Act (WARN)

Anyone know if the recent layoffs fall under this act? Many were given the last day of Aug 15th. Some accounts have stated their separation day is Oct 3rd.

This is massive as the WARN act requires 60 day notice.

If they subtract the final days from your severance, and you end up with nothing, is there any reason or rationale, at all, to sign anything?

I think there is a very strong case for age discrimination lawsuits too. Having (unfortunately) been in a position that allowed me to observe how HR and employment legal work, even before of all this - the amount of lawsuits bought by ex-employees for discrimination, bullying etc was far higher than the industry average

Highly suggest anyone laid off speak to a few lawyers about your unique situation and make sure you’re not getting royally screwed. WARN is a really good place to start. Don’t sign anything if you can help it.

Doesn't the WARN act require a certain number of people at a site to kick in? Also, I understand that the California threshold is lower than the Federal one.

I learned today that the WARN Act pays me through October. Which means I am technically an Oracle employee for the next two months, getting paid, and doing nothing. I already have a few job offers close to ending, so the idea of getting paid double is kind of exciting.

On the other hand, I'm thinking that even though I anticipated this layoff, I could have also just taken a few months off. But in this economy... that's rough.

In NY State, it's showing 90 days:

The WARN Act requirement to provide 90 days’ advanced notice has not been suspended because the WARN Act already recognizes that businesses cannot predict sudden and unexpected circumstances beyond an employer’s control, such as government-mandated closures, the loss of your workforce due to school closings, or other specific circumstances due to the coronavirus pandemic.

In my team CA employees have until Oct 3rd (WARN period officially starts Aug 4 according to my package)

Employees outside CA got Aug 15 as last day

I'm reading that that its Federal law

Even if it is state mandated. No one was given 60 days notice that layoffs were coming.

WARN act is a state mandated. Only certain states fall under it.
