Why should anyone be protected for layoffs just because they're on leave?
Yes I knew two women who were not laid off but given really cr---y work to get them to quit right after being on maternity leave, they don’t have to pay severance if they make it awful enough for you to want to leave first.
They would rather pay for your travel to get an abortion then pay for maternity leave....

I’m about to go on my leave and honestly I hope they do lay me off. It will motivate me to get out of this sh-t job finally and save me from the leadership full of id--ts
When I worked at Sears they were notorious for doing this.
Not illegal so long as the layoff or firing has nothing to do with the fact that you took a leave and are on FMLA. For example, if 5 people in your team get laid off and you’re one of them, that’s not illegal just because you were on leave because they’ve already demonstrated that there were others laid off in the same or similar positions or a function that were not on leave. It’s a quick google search that you can do to validate my answer, but the basics are that you are not afforded “special protection” just because you are on leave when layoffs occurr.

I was basically hired for an internal role right before I went on maternity leave and they ended up giving my job away; when I was back they gave me an assignment I had no expertise in and was basically a sh-t show that I would get blamed for. I looked for a new external position and left; and made sure I put in my exit questionnaire I left due to what I believed was discrimination. Never heard back from anyone and not shocked. The company will sc--w your over if they can. I was an excellent employee with a proven track record and great work ethic. Apparently getting pregnant was a career ki---r.
