OSHA RULE STAYED

On November 16, 2021, the Judicial Panel of Multidistrict Litigation consolidated all petitions for review of the ETS (including the Fifth Circuit ruling) before the U.S. Court of Appeals for the Sixth Circuit. The Sixth Circuit has jurisdiction over federal appeals from the states of Kentucky, Michigan, Ohio and Tennessee. Of the 16 judges, 5 have been appointed by Democratic presidents and 11 have been appointed by Republican president

On Friday, November 12, the U.S. Court of Appeals for the Fifth Circuit issued an order staying enforcement and implementation of the federal Occupational Safety and Health Administration’s (OSHA) COVID-19 “vaccine or test” emergency temporary standard (ETS). The order was issued after an expedited briefing and in response to a petition filed by various employers, states, religious groups, and individual citizens seeking a temporary stay of the ETS pending judicial review to determine if a permanent injunction of the ETS should issue. While the Fifth Circuit will not necessarily be the final word on the matter, the ruling signals that at least one federal appellate court has made a preliminary determination that the challenge to the ETS will likely succeed on the merits. Pending review, the ruling effectively nullifies the ETS as OSHA is barred from both enforcing and implementing it.

Replying to 1sld+1dRhf5js: you'll problem reject this as fake news but fully vaccinated people are also less likely to contract the coronavirus than unvaccinated people. If they don’t contract an infection, they can’t transmit the virus to others.

A lot of companies and other countries are requiring testing two times a week and not one. If they care about our health we should have twice a week of unvaxxed at a minimum.

The government already has ALL of this data! How do you think they have all the data on how many people are vaccinated? This information is not secret. A company can (and has the right) to ask for these records. Ultimately it really isn't a big deal....

To everyone back in the office 1 week a month … try not to think about the farts building up in your chair or bathroom unwashed hands caressing your mouse the other 3 weeks. Some CAs have been told no personal items as theirs is a shared cubicle.

To people worried about data collection… have you never run an Accurrint search w/ LexisNexis?

I’m wondering how long SF will keep paying for weekly testing before passing that cost to the employee?

Vaccinated or not, the question does come to mind why they need all this data on all employees, even remote workers who are not even applicable to this situation.
