If I resign in January, will I be paid for my year’s worth of vacation? I assume carryover will be paid.

The dingle berry claiming it is pro-rated is probably some XOM-loving goon trying to raise doubt in peoples’ minds and discourage them from sticking it to the company by waiting until next year to leave when vacation resets.

Because of the PIP, many of the REs I know have applied this tactic in 2021: don’t take any vacation day until you hear the results of ranking, and also have 10 days carried over that you don’t touch before the results are communicated. If they were PIPed (and some were) that gives them 30+10 days of pay, essentially two full months, on top of the three months PIL (of course no RE would go for the PIP).
So yes, you get your full vacation payed if your employment ends.

On the first day of each new year, you are entitled to whatever amount of vacation you have, not just some portion of it.
Why you people can’t just look up the vacation FAQ on the Intranet and stop arguing about one of the very few things that are still clear in this messed-up company ! LOOK-UP-THE-FAQ !

I am a former XOMer that quit the first week of January 2021. I was paid out all of my carry over vacation and 100% of my 2021 vacation time.

I was not expecting it and no idea if any policies have changed over the last year but it was not prorated for me.

It's prorated by months of service for that year. You can't leave the first week of January 2022 and expect them to reimburse ALL of your 2022 vacation, come on guys. That would be absurd. For some folks that might actually be more reimbursement than a yearly bonus.

If you leave January 31st you get your carryover paid back and that's it. If you leave Feb 1st, you get your carryover plus 1/12 of your 2022 paid out because you served a month at the company. Leave May 1st? You get 4/12ths, or one week paid if your vacation is 3 weeks (120 hours) and you haven't used any.

What planet are you psychos living on that Exxon is dishing out 160+ hours of pay to folks making 150k/year when they leave in January?? That isn't explicitly stated anywhere in the company policy and if you ask HR for all of that vacation to be paid out they will laugh in your face.

there is still no clear answer on what is the employee entitled to.

is it one- twelfth of the holidays if they quit on 31 January? or all of the holidays - twelfth/ twelth. even if they quit 31 Jan?

It's not federal law, it's actually only a state law in California and Illinois. But ExxonMobil voluntarily does it for all employees (in the US at least).

Look it up on the intranet, under vacation FAQ. In case of separation (includes retirement) the company has to pay-in-lieu for any unused vacation that the employee is entitled to. Federal law. Even EM hasn’t gone to the point of challenging federal law provisions posted on their own Intranet.

For those who are still lobbying for full-year leave balance encashment - ask yourself this simple question: since when in EM, have you ever gotten to have your cake and eat it?
Especially when it comes to HR policies?

All recent, voluntary and PIL departures in 2020-2021 had encashed their leave balances on a pro-rata basis within the fiscal year.
This is per HR guidelines (with formulae provided) circulated to all supervisors and managers.
Supervisors had to run through the severance/PIL “payout” package, including how each monetary component was derived, with each employee concerned.
The employee had to sign and accept that the total amount is correct, as calculated by HR (including the pro-rata balance of leave encashed), before he leaves the company.
So there are no rule benders, nor false starts. HR guidelines were mandated and deemed final.

At least in Canada It depends on your initial company start date . For instance if you started on Jan 5 20xx and resigned on Jan 6 2022 you would get full entitlement.

But if you started on June 5 20xx and resigned on Jan 6 2022 then your actual would be only 1/2.

Nah they prorate it by months of service completed for that year. You will get carryover paid out but do not expect for them to pay out all of your 2022 vacation if you bail in January. In fact, you'll likely get none of it. Even if you left in August you'd only get 7/12ths of your unused vacation paid out.

I emailed HR about this sometime during 2021 and they said vacation days were all paid out and didn't say anything about it being pro-rated. It is possible they just weren't mentioning that important detail though... wouldn't be surprised.

Anyone know if one could start a new job while on vacation at their current job? And either (1) tell XOM/supervisor that your last day will be the last day of your vacation allotment for the year, or (2) take your full vacation allotment and on your first day back give your immediate resignation, turn in everything and walk out.

I'd consider the above a d*ck move at any other place than XOM.

Prior year’s carryover leave: Yes
Full-year 2022 leave ENTITLEMENT: No
(HR will pro-rate your leave balance, based on the actual date of resignation).
This had been similarly applied to the PIL cases in 2020. So go argue with HR.
