Cease and Desist from Xerox

Just got the classic cease and desist letter from Xerox. I had left the company and went to a competitor about 6 months ago. Admittedly, I’ve been in contact with my previous customers... Many of them will be leaving Xerox regardless due to inability to supply and service them correctly.

Anybody else gotten such a letter? Anybody actually been sued over a non-compete?

I worked at one of the larger XBS cores and there were many sales reps that would leave and take their customers with them. They would have mother X send out these cease and desist letters and they were scare tactics. They never followed up and most likely lost millions in revenue.

You must be in sales or something comparable as I have never heard Xerox Direct Service having to deal with non compete stuff. Usually they give you a 5 minute warning that you are gone which of course they take your computer, Fluke meter etc....

🍿 🍿 this was an extremely curious move on your part. Regardless of whether they would leave on their own and regardless of how xerox treated you, you signed on with xerox which includes a non compete clause even if you were once XbS and absorbed by Xerox. When I gave my 2 weeks the first question was if I was going to a competitor. If I was their policy is to take your laptop and have you led off Prem immediately. Good luck with a lawyer signing on with the ‘they screwed me’ defense and the fact that you ‘admittedly’ did something now seen by all on a public website.

No matter how righteous you might believe you are because of things like reduced benefits, none of that matters in a court. Your air quotes “contracts” don’t matter to a judge.

Don’t f~~k with legal unless you’re a lawyer or have a good one. Otherwise you’ll find out real quick why they get paid as much as they do.

I’m not trying to minimize the pain of what you experienced but if some of y’all are going to break actual legal contracts because “they didn’t match my 401k” you’re going to go lose your shirt in court, if you even have the resources to make it that far.

Don’t be a martyr. No ones following you into that breach.

The question is did you sign "non-compete" paper work anytime during your career? If you did, they have you hook, line, and sinker. If not, you should be free to do what you wish. I checked HR several years ago to double check if I had anything along those lines (I know I didn't since I would remember signing something like that ) and I have an email stating that I had no "non-compete" paper work in my file... Good Luck...

They broke many "contracts" with me:

  1. Stopped giving me the company match for my 401k, which was done DURING THE YEAR rather than announced prior year. I made adjustments to my saving plans last year because I expected them to provide the match, which they bailed on.
  1. Took away MONTHS of severance I would have gotten if I get laid off.
  1. Salary increases are a JOKE. I used to consistently get 5 to 8% increases each year due to performance, but now we're all lucky to get 2%.
  1. I have been covered up in work that used to be done by several others that have been laid off. And no, I didn't get a salary bump to make up for it. And I still have my original job to do too.

So guess what? I say take every old customer you can get. Bleed this company dry, just like they're doing to all of us.

If I was involved in a lawsuit, however dubious, my first move wouldn't be to explain what I'm being sued for online in a sentence starting with "Admittedly."
