In California yes.
I didn’t get any severance and they didn’t give me any formal paperwork other than standard resources to approach like unemployment agency, cobra related links etc.
@qrx+18lnRGO8 - You can’t get 60 days, severance and unemployment at the same time. To start, you’re not technically unemployed until the 60 day notice period expires - you’re still drawing regular paychecks and most benefits, they’re just telling you to stay home and not sign in. Once that’s clear, revert to your local state laws on unemployment, but it’s most likely that you can apply, but you won’t receive any money until your regular severance pay stops. WF will continue to pay your severance every two weeks unless you notify them that you’ve taken another position.
You'll receive it. I was terminated from another company for the same reason. Poor performance . Unemployment asks you why you were terminated. Tardiness, low performance, equipment tampering, conduct. Mine was low performance. I was accepted for U/E.
You don't receive severance if terminated for cause. Severance is only paid out if you are involuntarily laid off.
Can I get the 2 months pay, serverence and apply for unemployment at the same time
OP- did they give you a severance package?
@feq+18lnRGO8 correct. "incompetence" is not considered a valid reason to deny unemployment. For the most party, it has to be a deliberate act by the employee, such as excessive tardiness or absenteeism, insubordination, intentional misconduct leading to damage to assets.
The only way to know for sure is to apply.
I believe it's up to Wells to approve it or not, but I don't think it's a good look for them to deny you during a pandemic.
Always apply. If denied, most states automatically appeal, and it is up to the employers to show cause. Cause is being fired for breaking some written rule, theft, but I don't believe it included "performance" as that is subjective.
You should get it. The govt is so overwhelmed there is no way to catch you. Say it is COVID related.
Depends on what your paperwork says is the official reason. Apply for unemployment anyways. Burden is on Wells to deny.
