Thread regarding Xerox Corp. layoffs

Xerox Non Compete Agreements

Anybody had any experience with these? Does Xerox fight pretty hard against a person if they go to a competitor?

Asking for a friend....

If they lay you off or terminate you then I doubt a non-compete applies. They cannot stop you from making a living after they get rid of you.

They sent me a letter when I first left but nothing again after that. Seemed like an empty threat to me, I was never too worried about it. Took customers away too.

I signed on with {BLUE} TEAM XEROX 30 years ago.. (Disclaimer - I was transferred to HCL last April... want to take a guess if I'm still @ The Big Red/Blue X?)

I have no recollection of signing a Non-Compete. I signed on when the Fax Machine was the greatest tech advance of it's day. Tell You what Xerox. You produce a copy of my signature on a Non-Compete, and we'll talk. Until you do so... well... Let's just say I'm not worried.. :-)

Get a lawyer for this kind of advice, they do this for a living

Maybe not as they haven’t gone after anyone in C-Suite who seem to ping pong back and forth between HP, IBM, Xerox and whatever else, but then again I doubt they would would posses any value add. But an engineer, developer, scientist maybe more of a concern as it relates to non compete.

just lie. not like lying is going to get you fired. what i do outside of work isn't really their business, neither is where i am taking my life to after quitting. Most of the things my bosses and co-workers think about me is totally wrong. they think i have a house, a wife, a dog (stock photos of a dog really), a new born. they even think i'm a pretty good pool player.

If you are worried then consult a lawyer. Others can give their opinions here but it really isn’t legal advice. Also I know quite a few people that gave their 2 weeks and they were asked if they were going to a competitor and if answered yes you give up your laptop and are walked out the door right then and there. To me is answer honestly. It’s the right thing to do even when the company has treated its people like c-ap.

I believe Xerox would have to prove serious financial harm would occur. I expect this would require them proving you would be using trade secrets or processes, or would likely take customers with you.

Most of us have probably signed an NDA when we came on board. That definitely is enforceable. I can't move to Canon and teach them about Vader technology if I was in that organization.

For those of us working on products related to FX or HP, I can't imagine Xerox would be able to or want to try and enforce the non compete if we left.

But what do I know, I'm not a lawyer.

Xerox does not know thier d*ck from thier a$$ right now. Just give your notice and don’t tell them where you are going. It will be fine.

Opinion answer, but I think xerox has its hands full. Unless you left breadcrumbs showing you took the cookie from the jar when you left, then I doubt they’ll waste their time.

The company is in a dire position these days. They don’t have money to fight the thousands of employees that have left or were let go recently. Don’t run out and steal customers, wait your time, but don’t lose sleep at night. Xerox has bigger fish to fry.

The laws differ among states. Google the laws for your state.. Also, doesn't hurt to pay a small consulting fee for a 30 min or 1 hour with a legal advisor. That way you're not looking over your shoulder forever.
