Thread regarding IBM layoffs

Anyone consider not signing the RA agreement and pursuing an age discrimination suit ?

I did, but don't believe the math justifies the effort.

I figure 90 days of 'severance' is worth about $40k, and year of health coverage subsidy for a couple is worth another $20k.

If I don't sign the agreement, I forfeit the $60k, so the ultimate settlement will need to be above
$120k (assuming 50% attorney's cut), before I see an extra dime.

I have not use any attorney before. Is my logic and estimates about right ?

It's simple math. OP stated 90 days of 'severance' is worth about $40k. 90 days is about a quarter of the year. 40 * 4 = 160

Wow, IBM must be run for the benefit of Americans, your colleagues who have worked extremely hard and delivered a great deal of value to both IBM and our clients in countries outside of the US will be overjoyed to hear that sentiment.

There is a huge range. Some IBMers are getting 45K in low cost areas and there are plenty of IBMers making 150K or more in base pay alone.

Why are people saying IBM employees get $160K salaries? Wow - in that case, I was way underpaid! That seems like a ridiculously high salary for this place. Am I wrong or vastly underpaid?

Hypothetical questions here: if a company's average age is older, and they lay off a representative slice of their employees, are they liable for age discrimination? If a school district gets rid of their kindergarten programs, and 90% of the teachers are female, are they liable for gender discrimination?

Just wondering if these sorts of lawsuits take into account the existing mix of employees within the company.

I'd sign the RA agreement.

What kind of work are you doing for IBM to pay you $160,000 per year? I'd assume someone earning that much would be able to find a new job. If that's not the case maybe it's less about age and more about value.

Me again iISDQ even if you sign and take the package you can still go to a Lawyer I don't think that will hold up because you were coerced into signing.Me personally i did not take any path,but if you feel like do sign and go to Lawyer

to late for me check your emails in the past if you received you look like a candidate for retirement .I received 2 in prior years before my 6/19 RA .That could be a smoking gun to bring to lawyer .I thought about this after i was gone

If u can get lawyer into contingency and u work in a State that does support “ at will” go for it.

The belief that you take the 90-day "pay off " without the ability to sue is not exactly true; more of a Big Blue intimidation play. You can do BOTH; there is legal precedent. Whomever on the thread said, thinking we can prove IBM has committed actionable, legal discrimination is "naive at best; stupid at worst" is misinformed. Perhaps they, in their naivety should do their homework as there have been many cases IBM settled out of court to avoid bad publicity. But they still got the bad publicity anyway...

Im not. Nope. I would rather take the money I need to support my family for awhile and put all of my energy into finding a new job rather than suing a company who has a bunch of high-priced attorneys with no soul that answer to the newest version of a lying t–d of a CEO. IBM execs are a bunch of a-holes and so are their attorneys. I'm just at the point where it's time to take my pennies and walk away. F them. Hope this answers your question.
