3M Earplug Lawsuit News

August 24, 2023: We have not mentioned the possible 3M earplug settlement in a while, so here is our latest thoughts.

The conventional wisdom is that these claims will settle sooner rather than later. We have had high hopes of a resolution before that quickly fizzled. But they have never been this high. One canary in the coal mine to watch for – the number of law firm that are no longer taking new cases. This may start happening sooner rather than later.

A settlement could take a lot of different forms and there is very little information swirling about how a settlement might be structured… or what the average settlement might be. We have tossed around a $50,000 number as a potential mark. That is probably overly optimistic. But weaker cases pull the average down. The bigger question is what will be the average settlement in cases with cases with serious and well documented injuries.

No, these law firms are not your "friends". They are in it for the money. Look and see what percentages lawyers take in these big lawsuits. That's money not going to the wronged people or fixing the environment.

According to Pentagon data, 85% of plaintiffs do not have hearing loss when using American Medical Association criteria (90% when using World Health Organization criteria). If settlement is with 15% of veterans who do have hearing loss at $50K each, settlement is $1.8B ... quite manageable for 3M.

The way I look at it is that 3M's code of conduct will not stop 3M from doing wrong things . . . like polluting the worlds water supply, selling safety product at outrageous prices that do not protect military personnel hearing, participating in illegal discrimination (based on race or age), or improperly influencing Chinese officials. In fact, those are just some of the things our company has done and each are in active litigation this year.

The way I look at it is that these law firms are our friends. Better than 3M HR. Better than 3M leadership. Better than 3M policy. Better than 3M culture. Better than EAP. Better than the Ethics Hotline. I hope the law firms continue to post and that they are there when the worst happens to one of us.

I was an employee that 3M did wrong to. I waited too long to contact a law firm and did not save evidence. The law firm I contacted apologized to me for what 3M had done but explained we did not have a strong enough case. You must make audio recordings, print out documents, and keep great notes. When the time comes, find a law firm.

$20bil to $30bil worth of payout to lawsuits for next 10 years. How much of the profits that 3M need to suffer? This company is not investable.

254,000 case by $50,000 average settlement. That’s $12.7 billion. Almost as big as the PFAS payout. This company is scre.wed.
