@lvj Except it is illegal. FMLA requires that a company hold the same or similar position for an employee while they are out on medical leave.
Employers may lay-off employees out on medical leave without violating the FMLA if a reduction in force results in that employee’s entire department or division being eliminated, or the employer can show that all similarly situated employees are being eliminated.
In 2019 an LL6 (woman) knew she was on the list and went out on medical. A month after she returned she was let go. So she got a bit more $ but otherwise had the same end result.

Just imagine having to lay off a team of 10, and 9 are asked to leave and 1 is immune because of their status, whatever it is - pregnant, married w/family, minority, ill, over 40, whatever. You're literally executing a reduction in force by targeting persons with/without a set of personal status.
Reductions must be indiscriminate and unbiased, period.
It is legal to lay people off while on medical / maternity leave. Many people at the tech companies had that occur.
I don’t know if Ford has laid off anyone while out in medical, but I suspect they have during at least one of the downturns.
Oh yes and I sued!
people have had their position vaporize while on medical. They had to find another job on return. To be fair one guy the supervisor did not think would return, the guy amazed us all at defying odds.
