Getting a job during lay off

I know it’s been discussed how severance and other stuffs work when you get a new job and let company know you are resigning earlier . How would that be categorized ? Would you need to let your future employers know you were involuntarily terminated ? Or it more of voluntary .

It is not illegal for previous employers to respond with why you left. However, Schwab, as well as most companies, follow the policy of not disclosing this information. Schwab only confirms dates of employment and title only.

As the previous poster stated, Schwab only confirms date of employment, and official title. Schwab never provides any additional feedback, positive or negative, nor does it indicate why you left. That is a policy.

A prospective employer can ask you why you left a former job and then can ask a former employer the reason for the termination. That is not illegal and it is not illegal for the former employer to respond with laid off, terminated for cause, etc. Would look bad if you said "looking for better opportunity" and it didn't square with what former employer says. Better to say something like "in October, 2023, nearly __% of the firm was laid off and unfortunately I was one of the employees who was impacted. Prior to the layoff, I had a track record of success and was able to [insert three key accomplishments from your experience with that company here]." (full disclosure - got that verbiage from LinkedIn). Mention layoff but focus on accomplishments prior to layoff.

It would be treated no differently if you gave your two weeks under normal circumstances. You do not have to disclose a layoff. That's your preference if you want to tell the prospective employer but it's not required

Technically it is illegal for future employers to ask this question. So when they ask "why did you leave your old job?" you are under to obligation to say it was because you were laid off.

you SHOULD answer in the form of:
"i am pursuing new opportunities that align more with my career goals"
"this position just really aligned with my values and the more i researched (hiring company) the more i felt a sense of belonging"
"the nature of my current role was changing, and i decided it was time to find something that was concurrent with my strengths"

regardless, you dont need to say "i was laid off" nor should you. answer in the positive, that you are seeking the new opportunity because of the role/company. Even if you arent affected, you should seek something new. With the re-alignment for the "disruption" as they call it, you can expect more work for the same pay with less opportunity to move up (because promotions cost money). Things are going to get way worse before they even begin to get better. If you havent started looking for a new role, you need to now.

If I'm understanding correctly nothing changes about that situation. You were still laid off, you just found a job during the 60 day WARN period. So that's an involuntary termination from Schwab.
