@bjjb+1lRIvVRJ do you mean you get paid the full WARN 60 day plus severance even if I start a new job elsewhere during that notice period?

You can start a job immediately. You won’t lose severance. They do ask that you inform them if you get another job, and they will end your benefits early and expedite your 60day pay. You still have to wait for the severance pay date though.

@1avy+1lRIvVRJ I've been trying to find an answer to this as well. It sounds like ultimately, you need to check any contracts you have. Idk what we have with Medtronic but assuming we get a severance and not going back to work at Medtronic in the case we are laid off, there is no problem and no need to inform anyone. My approach will be to not tell anyone if I am laid off with severance and find a new job just to be safe.

See my above post and comment from when I was laid off in 2020.

I would bye curious how this works with the severance? If I start a new job elsewhere, do I lose that?

I've been selling customer details en masse since the day I left.
They can't hold you back from making a living.

The court has ruled against non compete in the US (March 5). No company can stop you from working for a competitor anymore, even if you signed a non-compete contract in the past, the law is retroactive, so that contract is void

Re: If they lay you off and you have an offer from a competitor then MDT will have to pay you to not take the competing job. So call their bluff and never put one ounce of respect into the validity of a non compete clause.

Who would we contact at MDT?

@ajp. Non-competes are illegal and unenforceable in California.

Unless you signed a non-compete as part of your employment, you can start straight away
