I am a Salaried Manager on a medical LOA and I received an email saying my LOA time is over and my request for additional time was denied. It said I need to return to work…..how long do I have to return to work before getting fired.

We’ll have you ever worked a job that requires you to do the work of 3 people? Have you ever also done that while being severely understaffed? Have you ever has peak time last all 12 months of the year with no downtime due to understaffing? Required to do back to back 15 hour inventory shifts? Stress and lack of sleep causes medical issues. There is a correlation you know.

Have never in my life worked a job where SO many of my coworkers are constantly taking medical LOAs. LOL

Just go see a mental health counselor for worry and anxiety and loss of sleep due to fear of losing your job....they will quickly certify your paperwork...a Medical doctor will make it difficult to certify papers sometimes.

On the flip side of this, there was 2 salaried Mgr.’s (1 floor and 1 office) who took LOA (They were both awful and and they both knew the writing was on the wall for them) 1 claimed she had a stroke, she was out for 3 months and kept trying to extend it. The only stroke we saw evidence of was when someone found her fb page and she was in Florida swiming in the ocean! She too was told that her LOA had reached its end. She never showed up back to work. The other one conveniently took LOA several times usually during the summer or peak hectic times. They finally figured her out as well and she also left without notice, good riddance, she was one “PITA” who would constantly call H.R. to make cases against her peers for the slightest reason. 1 was someone touched her shoulder while passing her through a doorway! Seriously!?

Oh my!!!!! Just call your states department of labor or department of employee industrial relations after I left macys I began my career there I am now a deputy director that's what I get paid for to help employees of all industries

If you have a medical LOA and up to date with Doctors signatures for an extension then you have them by the short hairs! The last thing HR wants is any lawsuits which unfortunately is why they don’t have the onions to fire those who abuse it.

Depending on your situation, you may have an option. Are you on short term FMLA? If not, then get the paperwork and go to whoever put you on medical leave and ask them to fill the papers out. This will give you an extended period of time up to 6 months. If you are currently on short term leave get papers for long term, which will extend it for up to another 6 months with new medical documentation backing up the need to continue the leave. If you've exhausted both then you'll need to return to work, or they will fire you.

I recently had this happen to me, and had to extend my time. Not only was i given a return to work by date, but I was told I needed to meet with hr and upper management to establish ADA accommodations before I could come back. Magically, HR and management were never available for meetings for such discussion.

Fortunately for me, I was approved for disability Social Security just prior to them firing me. I didn't want to leave, but it was better than being fired. When I called to tell them I was not coming back people starting freeing schedules for meetings. I told them it was too late at that point.

Good luck to you, I hate to say this but you're about to learn what hourlys already know, HR and upper management do not care. You're a number on a payroll expense report, and nothing more. They are looking to reduce numbers anyway possible and that includes eliminating jobs.

As a final word of caution, watch your back and keep your head on a swivel. You may jump through all the hoops, return, and still be let go in the future for some lack of job performance BS, or even demoted. Remember, FMLA holds a position in the company, but not necessarily the same one you currently have. If you take the extended time off, they may tell you they had to replace your position based on "business needs,", and legally there's not a thing you can do about it.

You can put in for an unpaid personal leave but your store manager can approve or deny it in store.

@OP Wasn't there a date in the email indicating when they were expecting you back? If you don't return to work it's job abandonment. No.one one here has the answers. You should reach out to HR for options.
If your reason for being out is a disability you may be eligible for an extension but it doesn't sound like that's the case since you were denied more time. HR is your best bet. You probably already have a representative that's been handling your case.
If you understandably don't want to go back find another job. Preferably not in retail. The grass isn't greener on the other side... it's just fertilized by different bulls.

@OP if your doctor has not extended your time, you need to return on the date listed on the notification. They will fire you if you do not return on that day.
