Has anyone not gotten a check for a week due to severance and then got unemployment the following week

What it says is; Some that were laid off had to sign an agreement in order to get the severance package. This enabled that person to get unemployment even though they also got a severance package.
The rest of the story is within that agreement, was a clause that you couldn't go after Noble legally for an EEOC case, among many other things.
I got a severance package when I was laid off a few months ago (pre-Covid). I had no problem qualifying for unemployment. However, as pointed out, the TWC will not pay you for the week in which you receive your severance payment, but there weren' any other deductions or restrictions.
I don’t understand. Does it affect unemployment or not.

Noble made us sign an agreement that we would not pursue legal action due to age discrimination, etc. before we got the entire package. I filed and got it.
(A) based on an alleged violation of the Civil Rights Act of 1991 (Pub. L. No. 102-166); or
Sec. 207.049. RECEIPT OF REMUNERATION. (a) An individual is disqualified for benefits for a benefit period for which the individual is receiving or has received remuneration in the form of:
(1) wages in lieu of notice;
(2) severance pay; or
(3) compensation under a state worker's compensation law or a similar law of the United States for:
(A) temporary partial disability;
(B) temporary total disability; or
(C) total and permanent disability.
(b) In this section, "severance pay" means dismissal or separation income paid on termination of employment in addition to the employee's usual earnings from the employer at the time of termination. The term does not include any remuneration received by an employee under:
(1) a release of claims or settlement agreement entered into between the employee and the employer:
(A) based on an alleged violation of the Civil Rights Act of 1991 (Pub. L. No. 102-166); or

i have not got my severance yet or filled for unemployment.
Yes, I got mine but you max out at $500 per week. They base it off your salary. But something is better than nothing. I got six months.
It looks like you will be eligible for unemployment except for the week severance is paid. It can’t hurt to go ahead and apply. When you submit the request for payment, you are asked if you were paid during the weeks being requested and you fill in the amount received for severance. They verify with the employer and make the decision if you are eligible. I haven’t tried calling in but followed the tutorials at twc.state.texas.us and was able to get set up for unemployment while on furlough. If you qualify they also get you set up for the federal Covid payment.
Years ago I was able to receive severance and unemployment at the same time.

Go ahead and file as soon as you can. They will not pay you for the week you receive the severance check. After that you get all unemployment benefits coming to you.
