3M Earplug Lawsuit Update

September 18, 2023

There are currently a total of 242,604 pending cases in the 3M earplugs MDL. That is a decrease of over 12,000 since the start of the summer. This modest downsizing is not related to the recently announced settlement deal, but rather the result of long overdue docket control measures implemented by Judge Rogers.

Based upon the $6 billion settlement and assuming a peanut butter spread, each veteran would receive $24,731.66 for lifelong hearing damage caused by inferior ear plugs.

This is not a class action lawsuit, thus individuals may decide to forego the settlement and take their chances for a higher amount in trial.

96% have to agree on this settlement. I will go to trial for my case. I understand not everyone is able to, but I've got 60% loss due, tinnitus, migraines, and insomnia thanks to a VBIED blast while wearing the requored 3M "ear pro". 24k is nothing for what I've lost. I know most vets will take what they can and walk away.

Hey, well Junior, you’re pretty ignorant. Companies fund salaries based upon excess profits, and if a company has to pay several billion dollars in fees, it does affect layoffs. But I would not expect you to understand that at your current grade level. So why don’t you just sit down, go have a sandwich, and shut up.

It’s going to cost far more than 6 million by the time all the dust settles.

Each and every single one of the quarter million claimants are all national heroes who only wore 3M earplugs, only wore them precisely according to the instructions, and whose hearing loss/tinnitus is 100% solely attributable to the faulty 3M earplugs. Without exception.

Don’t think for one minute that the ~$2 billion in plaintiff attorney contingency fees had anything to do with these lawsuits.

Ummmm. Sure.

If the claimants were only soldiers that had actual hearing loss due to situations where they used the hearing protection correctly, they would be compensated appropriately. But that’s not the case.

Our litigious society has yielded a bunch of fraudulent claims. The settlement is an admission of it.

Everyone loses except the lawyers.

You're not factoring in the 30-40% that the lawyers pocket let alone potential tax implications. Sadly, I'd guess the settlement money per individual after all these factors is closer to $16-18K. Anyone have knowledge regarding the tax liability?

$24,731.66 is peanuts.
