Judge blocks 3M from shifting liability on earplug lawsuits

And in the latest ruling, Rodgers said 3M was "masquerading as the hapless wrong party defendant and purposefully ambushing the other side with a wholly contrived strategic position," and she barred it from "shifting blame to the Aearo defendants".

Funny that the quote was from the firm where her daughter works. The conflict of interest is criminal.

Yes, the dude acts as if his saying “family members in military” gives him some unique understanding. If you did not wear the uniform, you are NOT a veteran in absentia.

You never personally wore your nation’s military uniform and have no firsthand experience with combat safety. Moreover, the “frivolous lawsuit” commentary you’ve trolled everywhere is old, tired, and factually untrue. You obviously do not believe in our system of government or simply chose to ignore the unalienable rights of Americans.

Do something constructive today and read the US Constitution.

Sell your shares at a loss ASAP. No reason to hope for a Hail Mary in the 7th circuit.

Frivolous lawsuits all around. The design was approved by US government and made to their specs. I have many family members in military, the last thing any of them cared about while in Iraq was if they put earplugs in properly or even had them in. A bit less troublesome than being shot! Heck, I lost 1/2 of my hearing but be honest, do you wear earplugs at rock concerts? They need to be sued next hmmm? Take some personal responsibility people.

Judge Rodgers is very clear that she thinks 3M is in the wrong on every point. The US has an appeals system to deal with situations like this. It is likely 3M will prevail in higher courts and emerge pretty much unscathed from this issue.

out of the 253000 claims , we might find 300 to be truthful and actual hearing loss on the claimant, the rest are ex servicemen and women chancing their arms(ears) on getting a small fortune, this is where the lawyers are making their money claiming for each claimant, the greed of them is what is costing time and resources and adding to the costs.

3M’s paltry offer to pay earplug litigants $3,952.57 each would be laughable if hearing 👂weren’t such a serious and lifelong by health issue.

Finish the HC spin and then Mother Mining needs to be real hardball and put bankruptcy on the table. Settle or be waiting for years to get a fraction.

Sorry for the pensioners who will be thrown into government bailout fund. People at GM who weren't uaw lost almost half of their pension this way.

I would like management on this site to answer "are we winning?" I was asked that many times when they knew damn well it was a tough day. What’s the matter- can't handle the same bs you dish out?

This latest ruling substantiates and proves that 3M leadership will say or do anything to avoid responsibility for the creation of faulty earplugs. Thank you judge for not letting them get away with it.

It should not be forgotten who was leading 3M’s patent department at the time 3M decided to file its “objectively baseless” patent infringement against Moldex (through which 3M’s “Flange Memo was produced during discovery and ultimately led to the largest MDL in the history of the Unites States).

Snipped from an earlier post:

253,000 pending earplug lawsuits and $1 billion placed in an account by 3M. This breaks down to $3,952.57 per veteran. Less than $4K after lifelong damage to their hearing?

Mike Roman = Disgrace

Monish Patolawala = Disgrace

Kevin Rhodes = Disgrace

Companies face litigation regardless of product; however, the sheer volume of earplug litigants makes it clear that 3M branded earplugs had flaws.

3M is morally and legally responsible for their actions.

In accordance with the US Constitution, a citizen has the right to seek redress for wrongs. A jury decides whether the evidence supports a financial award.

If one opposes the judicial process, you are opposing the US Constitution, and I question your commitment to the threads which tie us all together as Americans. 🇺🇸

In company-wide meetings, Roman repeatedly downplays the earplug litigation. Kevin Rhodes, Executive Vice President and Chief Legal Affairs Officer, has failed and he failed because like Roman he has no moral compass.
