Prepwork before the sale

In anticipation of the sale closing on Monday, February 2, 2015 for most schools, ECMC/Zenith Education Group plans to send individual offer letters to prospective Zenith/ECMC employees during the week of January 26. Upon accepting the offer letter, all of us will need a new Form I-9 (Employment Eligibility Verification Form) completed in conjunction with federal law. While the Form I-9 (“I-9”) may not be completed until offers have been extended and accepted, in anticipation of the need for thousands of new I-9s to be completed within a narrow time frame, we ask that you take steps now to prepare and locate the necessary required government documents to ensure timely completion of the I-9. If you are a remote/work-at-home employee, we are also asking that you to begin now to source a local Notary Public who is willing to complete the Form I-9 and act as Zenith’s representative to examine your identity and employment authorization document(s). Further instructions for completion will be forthcoming.

Some documents show both identity and employment authorization (List A). Other documents show identity only (List B) or employ¬ment authorization only (List C). You are allowed to choose which document(s) you want to present from the Lists of Acceptable Documents, contained below, provided they are original (no copies, except certified birth records). If you choose to use identification from List B and C, the name on both documents must match.

Lists of acceptable Document

LIST A: Documents That Establish Both Identity and Employment Authorization – only one document from List A is required

All documents must be unexpired.

  1. U.S. Passport or Passport Card

  2. Permanent Resident Card or Alien Registration Receipt Card (Form I-551)

  3. Foreign passport that contains a temporary I-551 stamp or temporary I-551 printed notation on a machine-readable immigrant visa (MRIV)

  4. Employment Authorization Document (Card) that contains a photograph (Form I-766)

  5. In the case of a nonimmigrant alien authorized to work for a specific employer incident to status, a foreign passport with Form I-94 or Form I-94A bearing the same name as the passport and containing an endorsement of the alien’s nonimmigrant status, as long as the period of endorsement has not yet expired and the proposed employment is not in conflict with any restrictions or limitations identified on the form

  6. Passport from the Federated States of Micronesia (FSM) or the Republic of the Marshall Islands (RMI) with Form I-94 or Form I-94A indicating nonimmigrant admission under the Compact of Free Association Between the United States and the FSM or RMI

  7. In the Commonwealth of the Northern Mariana Islands (CNMI) only, a foreign passport along with special documents issued by the CNMI.

LIST B: Documents That Establish Identity – one document from List B must be presented in addition to one document from List C

All documents must be unexpired.

For individuals 18 years of age or older:

  1. Driver’s license or ID card issued by a state or outlying possession of the United States, provided it contains a photograph or information such as name, date of birth, gender, height, eye color, and address

  2. ID card issued by federal, state, or local government agencies or entities, provided it contains a photograph or information such as name, date of birth, gender, height, eye color, and address

  3. School ID card with a photograph

  4. Voter’s registration card

  5. U.S. military card or draft record

  6. Military dependent’s ID card

  7. U.S. Coast Guard Merchant Mariner Card

  8. Native American tribal document

  9. Driver’s license issued by a Canadian government authority

LIST C: Documents That Establish Employment Authorization – one document from List C must be presented in addition to one document from List B

All documents must be unexpired.

  1. U.S. Social Security account number card other than one that specifies on the face that the issuance of the card does not authorize employment in the United States.

NOTE: A copy (such as a metal or plastic reproduction) is not acceptable.

  1. Certification of Birth Abroad issued by the U.S. Department of State (Form FS-545)

  2. Certification of Report of Birth issued by the U.S. Department of State (Form DS-1350)

  3. Original or certified copy of a birth certificate issued by a state, county, municipal authority, or outlying possession of the United States bearing an official seal

  4. Native American tribal document

  5. U.S. Citizen Identification Card (Form I-197)

  6. Identification Card for Use of Resident Citizen in the United States (Form I-179)

  7. Employment authorization document issued by DHS

Realize that if you agree to serve as an employer’s Authorized Representative, you are NOT serving as a notary in any capacity. The Form I-9 does NOT require a notarial act, therefore you must NOT affix your notarial seal impression on it. You are signing the form in the capacity of Authorized Representative of the verifying employer, so we recommend that you indicate “Authorized Representative” as your title, not “Notary Public.”

Since Authorized Representatives are designated by the verifying employer, we also feel that ideally, such designation should come to you straight from the verifying employer, through direct verbal or written communications. It is less than ideal for the employee who is the subject of the Form I-9 to come to you because he’s been “told to find a notary.” Bottom line: if you have any doubts at all that you have been designated by the verifying employer to serve as an Authorized Representative, then decline to perform the service.

ASN’s Recommendations

To protect yourself and avoid pitfalls such as performing non-authorized “notarial” acts or notarizing your own signature, consider these recommendations.

Always remember that anyone can be designated as an Authorized Representative for completion of a Form I-9. Notaries are sought out because they seem well-suited to perform an Authorized Representative’s tasks, not because the Form I-9 requires a notarial act (it does not).

The verifying employer should designate you as its Authorized Representative through direct verbal or written communications.

When signing the Certification statement on the Form I-9, realize that you are signing under penalty of perjury… don’t sign unless every word of that statement is true. (If the employee’s date of hire is blank or unavailable, we recommend that you not sign the Certification.) Your true capacity (title) would be “Authorized Representative,” not “Notary Public.”

Decline to serve as an Authorized Representative if you are asked to:

(a) Sign/seal the Form I-9 in your capacity as a notary;

(b) Affix your notary seal next to the Authorized Representative’s signature on the Form I-9;

(c) Complete a written statement of any kind that you are then expected to “notarize” yourself;

(d) Make any certifications as “Notary Public” unless you are performing a notarial act that is authorized by your state.

To the original idiot replier notaries don't complete documents for you. They simply verify your identity and signature. Someone hasn't ever used a notary.

You dolts still have to fill out the I-9 and have the notary "notarize" it. There are a lot of bright people on this board.

According the American Society of Notraries, Notaries should not complete I-9s for employees. ECMC needs to designate someone local to do it. http://www.asnnotary.org/?form=i9forminfo
