@Anonymous1377. Actually "the old tired lawyer" raises some valid points. 1. It is not normal (but hardly unheard of) to go to the FIRST case management conference telling the judge that you intend to file a first amended complaint("FAC"). 2. The BIG question will be does California "have the goods" being the evidence to support the factual allegations of the complaint". a. On advertising non-existent programs (That is Exhibit A) b. Using military logos (The claim is that it is improper). (That is Exhibit B) c. "Falisfied" job placement representations. (While the job placement representations are published and presumably not in dispute, the claim of "falisified" certainly will be. 3. California wants a court (e.g. bench or nonjury) trial and CCI wants a jury trial(This would imply that CA is going to be arguing the case on "technicalities" more than on emotion) 4. CCI is probably looking at a legal bill of $1 Million to defend the lawsuit assuming it goes to trial. 5. The possibilty of the case settling always exists. CCI and the state may both decide that it is worth settling the matter. The last lawsuit settled for about $7 million. Not clear what number the state would be willing to settle at. If I had to take a guess of settlement numbers then I would be looking at somewhere between $10 and $30 million. 6. A BIG part of California alleged damages come through numerous violations of the prior settlement agreement with injunctions prohibiting CCI conduct. If CA prevails on that part of the complaint then CCI is probably looking at a judgment over $50 million. 7. The lawsuit has proven to be an ABSOLUTE DISASTER with regards to CCI enrollments in California. Talk to a Heald or Everest CA sales rep and they tell you that enrollments are dropping over 20%.
