Class Action Lawsuit - Overtime Exemption Violation

How many interested parties would be willing to join a pending suit against NetApp? Keep in mind they will claim we were highly exempt, but the bottom line is they refused to pay us overtime because we were salaried however, our clients were charged in real-time for our work in excess of 40 hours consistently. That’s a lawsuit folks. This post will probably be deleted like the last one. Ask yourself why?

I spoke to the attorney representing the current class action against IBM. They are now collecting information regarding NetApp. Party plaintiff is already of record and there are more joining. This is due to age discrimination.

Useless technology today. Better to be laid off now than to drown with the ship in a few years. No client cares about storage much like no passenger cares if it's Boeing or Airbus. Just deliver the service competently without excuse.

This comment thread totally explains why NetApp (and someone mentioned IBM?) are where they are today. Society, not companies, will lay these people off.

Be careful... ibm lost a similar suit about 10 years ago. While employees did get a settlement check to compensate for the OT, ibm then made all employees in certain job bands hourly and cut their pay by 15%.

Signing the NDA is I’ll advised. If you don’t have to sign it, don’t sign it. Does this attorney have a means of contacting them specific to the case with NetApp? I’d have no problem becoming party plaintiff. I’m 55 and they laid me off because of my age and salary.

Don’t worry about signing the NDA the class action attorney is suing to overcome that in the IBM case. I think he can get everyone out of that.

They don’t allow personal info (names, phones, addresses and similar) nor direct advertising, think that’s why the post got nuked.

Not convenient in cases like this, but I guess if they would allow it, we would have more slandering posts and more spam.

The firm suing IBM on behalf of workers for the age discrimination suit is Cohen Milstein Sellers & Toll and Johnson Webbert & Young. Google IBM class action. This form is notorious for having posts deleted.

What’s the contact information for the attorney that is handling IBM case? That will be the better route for this case in general. If you were laid off, do not sign the NDA specific to your last day of employment. You sign your rights away.

There are likely literally hundreds that would join! The attorney who is handling the IBM class action suit has already been contacted and he is the most feared employment attorney in America! He is pondering this but I am certain there would be so so many. NetApp violates so many employment laws it’s amazing! Toxic toxic toxic company!
