CLEC is for the most part deregulated. They mostly work behind a customers demarc, on the CPE side of the service. So for example, ATT would provide the service to the demarc, and WS CLEC would take it from the ATT demarc and take it inside the customers business.
ILEC is regulated by state public service commissions (PSC) and the FCC. They have to follow tariffs and regulations. ILEC provides the service to the cust demarc, and in most cases, past the demarc. Tariffs, as well Unions, prevent WS CLEC techs from working on anything in the ILEC market, unless they are there to assist an on-site ILEC tech. If the CLEC tech is the sole tech working on an issue in a WS ILEC territory, then they are breaking state PSC tariffs and union/company agreements. In other words, it's illegal for CLEC to come into ILEC areas within the same company.
This is also one reason, as mentioned in another post, WS keeps putting ILEC traffic on CLEC networks. They don't have to follow the tariffs and regulations as if they keep it all on ILEC equipment. I also strongly believe that this is also being done to "cook" the books and show Wholesale and Enterprise is growing, when in fact they are not. Most orders we are working in ILEC are coming in as Wholesale/Enterprise orders and being put on CLEC back-haul.
So that brings up another question,......if CLEC sales, or splits into it's own company after this is all said and done, will CLEC say that all these customers that are for all purposes ILEC customers, CLEC customers because of the back-haul to the broadsoft switch. WS is moving everyone they can from the ILEC owned metasolve switches to broadsoft as fast as they can.
