I know in the past associates are ranked before a layoff from top to bottom by their managers at least at higher levels.

When i let my tech go, my DM said her "name was pulled from a hat"....lol. She was a low performer, and my only one. So i let her go......Then a week later, we lost my part time 3rd pharmacist and went to single coverage. I discussed this with my DM at length, he called it a "cleansing" of the bad eggs. While some were dead weight, we still cannot replace their position ya know? ?
The answer is YES for sure....my DM was able to choose who was cut.... i watched him do it.....one bad egg at a time...in come cases we lost a great egg, but only because he probably ran out of bad ones.....lol. this company is turniong into straight SCUM.
A good employment attorney needs to look and have the formula and algorithm examined to see if it is skewed in anyway to be discriminatory. Wal-Mart could definitely be liable if so.
It's my understanding WMT hired a third party consultant to come up with a formula and an algorithm so layoff candidates are selected by a computer system.
This removes discrimination liability from WMT.
They have done the same thing during the previous round of layoffs.
