Regarding Unemployment Insurance and Your Rights

This is a sore subject that has bothered me greatly for a long time, and this is just the forum to raise a discussion of it: Unemployment insurance and your rights. Here's a basic outline of how it works, and how Walmart approaches your claim for it:

  • We don't even have a choice about having the premiums deducted from our checks. It's automatic upon signing the W - 4s.

  • No one will ever present a convincing argument to me as to why, upon a job termination not of our selection, that we should even have to fight for it. Short of you having commited gross negligence --- like punching out a manager (tempting tho that is), for example, that's YOUR MONEY.

  • I say, given the reality of how this all lays out, be smart: whether your termination happens unexpectedly or, better for your case, you've been seeing it coming for some time, keep cool. Document everything you can -- and get witnesses. Line up your case in your favor, same as the company will be lining up theirs against you.

  • When it comes time to appeal your unemployment claim's denial (and Walmart assuredly will try to do that), present your case, stay cool, stick to the facts you've gathered, and fight it with everything you have. This is YOUR MONEY THEY'RE TRYING TO KEEP FROM YOU. Again, you didn't even have a choice about havin g to pay into this insurance policy----and your sure didn't have a choice about losing your gainful employment. Fight for what is rightfully yours!

Unemployment is taken from payroll, it is part of what is figured for your employment package and is totally paid by the worker, regardless of how you sl--t "employer contributions." Thats like saying your vacation time or ppto time is gift from walmart. Employees earn that money. Government and companies use employer contribution terminology to weaken workers rights and protectons.

Not guarantee of employment does that mean you are temporary employment? When they hire you or at least when they hired me I thought after 90 days I was offered guarantee employment. How does this work? Is this fair labor practice?

I was fired late last year after nearly 20 years with walmart. Management made up horrible lies about me, wrote me up for one bs thing after another, and made my life a living hell. After they finally got me, they fought like demons to block my unemployment $$ and the judge sided with them. I called a lawyer who told me my only option was to sue and he laughed at me and told me to cut my losses. So yea, there crooked as sin alright. The poster of this was right, I should of documented everything better and got witnessses, thats what screwed me. I'm at a new job now and things are better, but I sure coulda used that money I had coming and they STOLE.

OP here. This was all an interesting experiment I conducted; I wanted to see how many people on here are management or management wanna-bes, or otherwise take sides with this villainous, scum swilling 'company'.

Of course I'm aware of the 1935 Unemployment Compensation Act.

It is both alarming and heartbreaking to see how the vast majority of you respondents slanted your posts in favor of denying employees their fair compensation upon losing their jobs. Some of you tried to twist words and justify unemployment on basis of incompetence or negligence----which I clearly stated I was not including under a displaced employee's fair compensation rights.

A lot of people who devoted much of their lives to the betterment of this 'company' have unfairly lost their long term jobs. They 100% deserve their Unemployment Insurance. I don't give a sh!t what ANY of you say in opposition........................and if you truly, genuinely still feel that Walmart is above accountability for the destruction they're bringing into the lives of innocent workers, I hope you all roast in hell. With broken backs :)

I disagree. If you were fired for attendance, poor productivity, etc, you should not receive unemployment insurance. Those are things totally under your control. The company didn’t terminate you. You terminated yourself.

There are both federal and state unemployment taxes. In all cases the employer pays the federal. At the state level, Alaska, New Jersey, and Pennsylvania have employee funded unemployment taxes. In all other states, the employer pays this tax. Always appeal if denied. In many cases companies will to sent representatives to an appeal. Generally, unless you've been fired for cause or left voluntarily, you will get unemployment.

You are wrong employees do not pay for unemployment insurance benefits out of their pocket (or paycheck). Individual employees do not contribute a dime to the American unemployment insurance fund. If you feel you were terminated for unjust cause, then by all means apply for unemployment and appeal if needed BUT..... In reality your employer contributes to the unemployment insurance fund not you.
