Windstream Lawsuit Says Charter Engaged In ‘Scare-Tactic Campaign’

"Windstream filed its lawsuit against Charter, the third-largest cable provider in the country, with the U.S. Bankruptcy Court in the Southern District of New York."

I got one of the letters. It did look like it was from Windstream until I started reading it and it put in a plug for Charter.

I got several letters but mine were about if we think we were involved to submit our names and other stuff. Windstream for many years was only service in our country town. Only phone company only internet , it was only recently one or two companies say they are in our area. I have been a loyal customer of Windstream like I said over 9 years. You would think they would have a reward for loyal customers . I know lately I have had problems with the security suite and outages, hopefully they will get it fixed because I still like a home phone and with Windstream they don't base your internet on how much data you use. You actually know how much your bill will be every month, I will stay with them as long as they are here or I am....

In some Windstream rural areas and small towns, there either is no cable company or else it’s really awful (underinvested and not maintained).

So to the extent that Windstream makes an effort there, it may be more productive than taking on cable companies where they’re more competitive.

One inherent advantage big cable companies have is that they pay less for programming (HBO, ESPN, Fox News, etc.)

But if their service doesn’t work well, that’s less of a problem. Also that programming advantage is meaningless when competing for cord-cutters’ Internet-only business.

I’m a cord cutter and Windstream’s local fiber trumps Charter’s poor Internet on my street

It doesn't pay to compete with cable. It pays to sell overpriced slow 10 year old internet to rural communities. The government even pays for the equipment. That's what winning looks like to me... DEEERRRRP

Even before WIN filed Chapter 11, Charter and other cable companies were getting fed up customers in droves because there are still many areas in the WIN coverage area where broadband speeds are almost dial-up speed.

Though the last few years WIN has made great progress in upgrading many areas, it is still too little, too late for many customers and businesses. Had WIN made this speed increase a priority 10 years ago, maybe they wouldn't have lost as much.

Maybe Charter will get a slap on the wrist, but cable will still eat WIN's customers for lunch all the time...

Windstream customers are already scared of being under a contract and experiencing outages with rate increases.

Windstream can’t support a businesss that run 24 hours 365 bc of all

Of the outages and mops. SLA and contracts are worthless.

Make sure you have an amendment clarifying when they can do mops. Otherwise you’ll be down 2-3 times per months for a mop and 2-3 times due to outages. Another 3 times for only 15 minutes or less and they’ll never admit you were down.

WS has a good case....Charter screwed up, even using their own previous lawsuit against DTV

“They still won’t admit cable companies sell faster internet Than them”

Windstream is faster here (Concord, NC) with fiber than Spectrum with coax. Just switched several months ago. I realize that system-wide, this is probably the exception.

Spectrum/Charter/Time Warner (3 names in 12 months) was great but slowly became unusable at this address. They were too cheap to split their node as traffic climbed. Then they lied to me. Glad to be shed of them.

Hope WS survives. Or, better yet, the old Concord Telephone owners buy back the local operation. (Probably little chance of that).

The pot calling the kettle black... Both companies are terrible. Sorry for those unlucky consumers that are stuck between a rock and a hard place being Windstream and Charter...

More detail at:

http://www.cablefax.com/distribution/windstream-claims-charter-is-scaring-its-customers

"There’s a bit of irony at play here… Charter itself emerged from Chapter 11 bankruptcy protection in 2009. Windstream pointed that out, noting that at the time Charter successfully obtained a temporary restraining order against DirecTV, which it said had deceptively implied the bankruptcy filing would adversely affect Charter’s customers."

Yeah, good luck with that one Windstream....don't have the money to see that through litigation.
