One has stated that this time if a layoff happens no severance will be given. What will happen with vacation time? Will we get it, or will Tony try to take that away too? I thought that our vacation would be promised to us, but I know bankruptcy may be different. Does anybody know the answers without speculation.

glad they got rid of me during the last layoff, got paid out all my vacation days for the year.
Windstream doesn't allow you to transfer vacation from the previous year unless you weren't able to take it all due to business needs.
They allow you to take your full vacation prior to you earning it. So if you were to take more than you have earned, you might owe Windstream the time back.
The previous CLEC I worked for allowed for two weeks to roll over. I always elected to allow two weeks of vacation to rollover as I have seen those who's final paycheck was gutted to pay back the vacation time they took but hadn't earned yet (Layoffs/Forced terminations/Quiting).
As for layoffs in WS, who knows what their policy will be going forward. I know they paid the vacation on top of the severance. They already reduced the severance package so I wouldn't be surprised if they reduced that again and also forced you to repay any vacation time you haven't earned yet that you may have taken.

You must not work here. Vacation is not accrued. It is available in full Jan 1 of each year.

I respectfully disagree. I earned my 2019 vacation in 2018. Think about it. The holidays are earned as you go.
I know someone that was laid off Feb1 who had used all their 2018 vacation time. Vacation for the entire year of 2019 was allocated and paid on the their final paycheck (4 weeks total). Not sure if it will happen going forward but I know they were totally surprised by it. This happen before the lawsuit announcement.
While there is truth posted here, 90% is speculation and bitter anger. Yes, WS may very well be up the creek without a paddle, but 1 person posting "no severance" does not mean it's set in stone. No one will know until it happens.
I am sure everyone will get their vacation time because it will be cheap for them considering it is still early in the year. You only get the time (in money) that you earned. Even though you have access to all your vacation time at the start of the year, it is prorated. To make the math simple, let’s say you get 12 vacation days per year. You earn 1 day each month. If you leave at the end of February, and didn’t take any vacation time, then you get 2 days (16 hours) worth of time in money paid to you and NOT the 12 days you get per year. Same if you took it all already, then you would be owing the company money back on the time you took off and didn’t earn yet. So same scenario, but you took all 12 days off already, the company would take the money-equivalent of 10 (12-2) days out of your last paycheck.
