Maybe they were offered BP jobs, but decided to stay in Sidney because it's home and it's where they want to live. Despite all of the bad things that people spew on this page, some of us like being in Sidney and are proud of the Panhandle.

My guess woild be that even though BP has shown no smarts whatsoever yet in this deal, they were not dumb enough to bring the whole family on because that family was the main contributor to the disaster that was Cabelas. Bringing them in in hugh roles would have meant instant doom.

I'm surprised that not all of the family got a cushy job with BP. Obviously the old man got a huge pay day and the daughter was able to slip into another made-up role, but why not the son and sons-in-laws?

In contract law, a non-compete clause (often NCC), or covenant not to compete (CNC), is a clause under which one party (usually an employee) agrees not to enter into or start a similar profession or trade in competition against another party (usually the employer). It's is law.

It's not the "law", it's an agreed upon company policy which makes it legal, but not the law.

Reading some of the comments you would think that because the media reported these allegations by Bass Pro, that they are now proven facts. I'm sure most believe Kavanaugh was guilty too, because the media reported Ford's side of the story. Yet know one knows what day/year/time/house/who was there/how she got there/how she got home, all we know is she had 1 beer.

By how things are worded in the article you couldn't open a simple T-shirt shop after being given severance because you would be doing irreparable harm to Bass Pro and Cabela's, because they sell T-shirts too. Heck a grocery store might not make the cut as they sell beef jerky, salsa, BBQ sauce, and seasoning too!

This lawsuit is a complete joke and an attempt to bury someone in legal bills before they even have a chance to get started.

Don't forget, this was all done while brother and sister (who is with BP) were discussing, drafting, planning, and signing a sweetheart separation agreement. BP won't win because the sister, a BP executive, was completely informed and aware of what was going on. This family played to a different set of rules than anyone else in Sidney.

Retail is cut throat right now so yes, it does matter when startups are using your equipment, connections, etc. to use to directly compete after signing an agreement. These kids have a massive amount of knowledge (about the industry, nothing else) and connections, way more than an average employee especially with who their dad is. Cabela's kept telling the Quad transfers that "business is business"...well ditto to them. They have never been held accountable in their life and acted like it.

On one hand you just have to say ha, ha! On the other, you wonder how much of this can be enforced in Nebraska if they can get the case moved or counter sue in Nebraska. But, regardless, many dollars will have to be spent on legal fees. Supposedly, there are other lawsuits in the same manner against numerous employees that left with the options and buyouts. Only hear about Highby and Nexgen. How is Bass Pro irreparably harmed by these start-ups? Just because something is marked confidential, doesn't make it so in the trade secret department.

You do not want to get into a lawsuit with a corporation...that has a legal department. The corp will drag their feet and your legal bills will balloon. It gets real expensive real fast...in the end your lawyer is the only one that wins. I know for a fact that Cabela's has enforced non-compete clauses in the past. If you signed the doc, it doesn't make a difference that you told them.

That response sounds like a guilt trip and their only defense is that they were the saviors of Sidney.

All that matters is the language of the documents and signatures of what they signed.

Believe it or not, Sidney, you have to follow the law too. Your town bubble has a hole in it now.

Bass Pro has been lying through their teeth to the entire community. At the end of the day JM is upset the City didn't give him $1M in grants. But the grants were set aside for NEW business, what NEW business has he created?

Hope both small businesses come out on top and counter sue as the defense statement suggest BPS removed the Non compete and non solicitation from the final exit severance agreements.

You really cannot fault the Highby's for the actions listed in this lawsuit, they never had to live by the same standards as everyone else. In fact, it was probably a shock to them that anyone even questioned the obvious conflicts of interest.

Yep, you can't take $2.2 million and sign a doc that says you can't call on any of the vendors or customers or compete and then just ignore the legal contract that you entered into. Also I can't believe the Sidney City council hasn't learned its lesson...they gave them $500k...unbelievable. Fool me once shame on you...fool me twice shame on me.

I can tell you how it will work out...Highby is going to lose. Despite what you hear non-compete clauses they hold up in court in almost all states. That's why companies use them. It also looks like they have proof they were working on this with Cabelas computers. Even Matlock can't get them out of this mess.

It gets even more exciting son and son-in-law we’re not sent to Shot Show this past year. Yet who shows up and on Cabela’s dime.

They were both caught setting up meetings and possible deals with vendors.

As to kicking Sidney while it’s down they drank the green kook aid for the over 20 years I was there. Anything the big C wanted was granted.

Read the lawsuit. Using a Cabelas computer to set up your new business? How stupid are these people? All these years of everyone signing these agreements under their watch and now they think that can get away with it.

And typical Sidney people on this sight of only following the rules that they want to follow and then blame other people when you break them and doesn't go your way.

This this judgement, that company was doomed to fail anyway, just look at it that way
