WARN Act for june affected (wave 1) - will it be revised?

For those who were affected in june - Will they come under the same WARN Act since it happend in less than 90days? If so will they get the one month back pay as they were only paid 60days + severance and not 90days?

This was one time offer to Malta employee due to mass layoff. Wanted to twist NY state arms. Same offer as you in Dec..no worries

Funny how Global gives the Malta people let go 90 days, but us let go in Fishkill only get 60 days?? Are we less unemployed? Do we need jobs less than those in Malta? Par for the course!

First wave was less than 250, so they were not bound by WARN act

From what I can tell, the timing is separated by >90 days

Wave 1 - last work day was 6/20 + 2mo notice = 8/20.

Wave 2 - last work day is 8/28 + 3mo notice = 11/28

So more than 90d between official last work day GF avoids back paying the wave 1.

Good question. I was wondering the same thing. I think WARN is site specific so would only affect Malta employees who were laid off in June. Not sure if it affects employees or if GF has a consequence.
