If you come back in the same grade job they have to pay you the same wage you were making in that job before being cut.
I realize they want you to wait those 91 days so they can basically hire you back as a brand new associate (and probably just give you minimum wage as opposed to the salary you left at), but seems to me the documentation on Payment of the severence seems to indicate that as long as you don't get hired back sooner than the amount of weeks you are getting paid for, you don't have to pay anything back. They sight an example of an employee receiving 2 weeks severence pay, is reemployed three weeks after the date of termination, they get to keep the 2 weeks severence pay. So I'm really not sure, unless you worked for the company for more than 12 years, why the 91 day thing applies.
There wont be any jobs available in 92 days unless other people quit. Don't bother. No one can promise you anything in 92 days anyway!

the post below is correct of why you have to wait. hopefully people who are severed find something else and do not have to go back to macy's. but they probably invite people back because there is so much turnover, there will always be some job, personally i would stay away. i know people who were severed, came back, to only have their job eliminated again.
After 92 days, you’re tenure and any benefits like amount of vacation days is wiped clean and you start over from scratch. Also, if you take a severance package now, if you come back before 92 days, you may have to pay a percentage of that back, but if you wait 92 days to reapply you won’t have to pay back any of it.
