WARN act, section under penalties. This is why associates are receiving 60 days pay in locations of closings. The business did not give 60 days advance notice so the penalty by way of the act is 60 days pay for each impacted. Terminations/performance issues do not apply to this act/situation and pay isn’t mandated. This is how the WARN act is referenced so often.

If state sues, and wins, the people getting laid off does not benefit at all from whatever the state wins... and everyone still pays the same amount of taxes

It's from Georgia, so, what would you expect? They gave 60 days notice, and those Sam's employees are being paid for those 60 days. There's no problem here. Yes, it's pretty low to do it this way, but, there's been no violation. You can bet Walmart's attorneys went over every action with a fine tooth comb before they acted. It's slimy and low, but, it's not illegal.
