Less than 55

How many people are close to 55 and will lose the huge benefit of retiring with your medical insurance? Are they targeting those between 50-55??! I will be 2 1/2 months shy off 55 at the QTD date. Corporate ba.....s!!

EEOC claim mailed in re age discrimination, retaliation, hostile work environment, etc. I decided to speak up about unethical and probably illegal treatment I experienced.

Encouraging all experiencing discrimination to file EEOC claim.

You can set up in their system and get an appointment that is months away to then file your claim and or mail in your claim request per their website. EEOC is federal government and in many states your filed claim with EEOC also handle state investigation.

They will review and determine if they will investigate and if they do they will interview employees and request documents and seek remedial corrections, etc.

If you are age 40 or older and have been with State Farm for 10 years or more, you can email statefarmlayoffsage@gmail.com. I will start a database. Please send me valid data (first name, last name, and age, your length of employment) and I will track it. If the ratio becomes large enough I will submit the complaint and data to EEOC. They will verify if the ratio is large enough to warrant an investigation into age discrimination. Usually, age discrimination can only occur if were told you were being let go due to age. There are exceptions to this. If the company knowingly chooses older people to let go and it's hard to know this information without complaints.

You have the right to complain to the EEOC at any time, and they will look into your case. If enough people complain, they can investigate State Farm layoff statistics.

If you think discrimination played a part in your layoff, contact a lawyer or the Equal Opportunity Employment Commission (EEOC). The EEOC will listen to your story, question your former employer, make a finding, and issue a right-to-sue letter you can take to an attorney, Conyer says. You can sue regardless of whether the EEOC finds in your favor.

Federal laws that prohibit discrimination include:

Title VII of the Civil Rights Act of 1964, which prohibits companies from making employment decisions based on race, religion, s-x (but not s-xual orientation), pregnancy or national origin, explains Neil Patrick Parent, an attorney with Reavis Parent Lehrer LLP in New York City.

Title I and Title V of the Americans with Disability Act of 1990, which prohibit employment discrimination against those with disabilities.

The Age Discrimination in Employment Act of 1967, which protects workers 40 and older.

The Older Workers Benefit Protection Act, which covers workers over 40 caught in a group layoff. The law gives you extra time to consider any severance waiver your employer offers and a week to change your mind after signing a waiver.

54 years old. 8 months shy of 55. I am so disappointed in State Farm. I have sacrificed so much over 29 years. Long extents on storm duty, time away from my family, lost time and life events. Family funerals I missed supporting the Farm. I can list event after event I have sacrificed. I promise you in the future employees will not sacrifice much for State Farm.

Keep this thread at top of “active” threads. Reviewing with attorney re possible class action litigation for EEOC discrimination violations, etc. complex case to prove and SF know that which is why upper management is able to get away with rediculous treatment of long time employees who are trying to hold out for promise of severance despite increasingly harsh and unreasonable, stressful working environment. If you were terminated or retired early due to targeting, or are currently being written up let us know how old you are and idea of situation by posting under this thread.

QTD - Qualified Termination Date.

The last date you are expected to work to get your Severance if offered. The date your current job ends if you are not selected for any potential position you may be competing for.

They sent an anti age discrimination form with a list of job classes, role, and age for my QTD. Most middle aged...

For those of you being hounded to death by micromanagement, I think you should find out just how obnoxious you can be before they finally fire you. Be like that guy in Office Space who brings in fish he's caught and guts them on his desk. Maybe bring in a power drill and knock down your cube walls.

51 with 29 years in and if I leave or get cut I am screwed either way. I leave I lose a lot of vacation, health benefits etc.. if I stay and try to ride it out I may die of a stroke or heart attack from the stress and agrevation this company puts you through for no reason. My job is not hard if you know what your doing but they make it impossible with the micro managing and needless nit picking of your work product while some co workers are incompetent and get away with it.

The company should be made to still extend those retirement benefits to people with 25 or more years or age 50. Either one should toll the benefits for a person. Hopefully someone that has been cut will file and a class action will result.

Class Action suit needs to be filed. Union or something. They are cutting folks that are about 50 with many years in. They know what they are doing and they are disgusting it like we are idiots. Please someone with the knowledge of class action. Please get it going.

49 with 30 years in. It should be against the law for a company to let you go and take the benefits that were offered when you took the job. When the cuts get me I'll be screwed out of any retirement insurance plus if you retire at 55 you can start drawing 401k without penalty. Not the case if u get cut before 55. If you are cut you cannot draw 401k till 59.1/2. Sf is f-----G their employees. They are trying to hide it but it's age discrimination and trying to cut people out of the benefits to save money. I doubt anyone who is 50 will make it to 55. We r sooo screwed.

Suddenly terminated in claims after 30 years just shy of age 54. Unemployment for up to six months. Lost retiree benefits and cannot draw on 401k til age 59.5 without additional 10% penalty. They saved a good $300,000 on me via loss of one year salary, severance and lost retiree medical / benefits and reduced pension for life. Not much you can do about it.

Hoping for class action for age discrimination as that is what is happening. And, FMLA/sick leave discrimination as that is going on too. They have been targeting people for past five years and are amping it up. They are making working conditions so difficult to get people to leave. I am still recovering mentally and physically from hostile and unreasonable work environment. I was so focused on working hard to make it to the office closure and age 55 I sold myself short, sold my family short. Glad I am out and building a new career and recovery humanity and health. Hoping everyone is doing ok that are still in it. So sorry for what you have ahead. Never thought I’d be going through PTSD from working at State Farm in claims. Counseling is helping. Being around normal people in the real world where everything is not timed and measured is really helping. It feels like I let myself be a test rat in a big experiment gone aray for too long.

Count me in on any class action over discrimination. Leadership/executive should be held accountable.

Be prepared to be terminated everyday you go to work. I wish I’d been mentally prepared. It was a total surprise and shock. Not much can be done now short of class action.

You cannot get the medical insurance when you leave UNLESS you retire and take the pension right away. This has always been “rule” at SF. The key is taking the pension right away. So if you leave before you can retire ( at 55), you will not be able to still be a part of the SF medical plan.

age 52, with Company 29 years, had just 25 months til age 55. QTD July 31st. I'll be screwed out of the retiree medical coverage, life insurance & HSA benefit. Fun times trying to ask our pathetic 3rd party benefits vendor about pension questions, what age can we draw, penalties, etc....still no straight answers on that topic.

There should be a class action suit in this. If you have 25 or 30 years in no matter your age when they cut you. You should get this benefit you work all these years counting on. We should get all the benefits that were offered when we accepted the job at Sf because it was considered. Please someone with an Attorney in the family. Please find out if SF employees could file class action for the deception of benefits taken away. 49 with 30 years in. So screwed.
