Thread regarding ConocoPhillips layoffs

I'm not getting VCIP!!!

I was let go in 2017 during the last round of reductions. Part of what I was told during the exit interview was that I'd still qualify for some VCIP when it was announced this year.

Now, I just got some mail on Saturday from my wonderful COP HR friends who said that due to a rule change, only people who are employed on December 31st 2017 will get VCIP now!!

Did anyone else get this note yet?

How can they change the rules from what they told me in the exit interview?

There was no such letter sent. Those laid off will receive a pro-rated VCIP, assuming general release of liability was signed (what you had to sign to obtain your enhanced severance payment).

I thought the package included a pro-rated portion of 2017 VCIP that was paid as part of the package.

I was also laid off in 2017 and was told by the HR rep that I'd be eligible for a pro-rated VCIP award. The severance documentation is ambiguous. It states that "generally to be considered for an award, the employee must be with the company through the year and remain with COP when VCIP is announced (in Feb)". It then goes on to say that certain terminated employees are eligible, including those laid off and with a signed waiver. I'm keeping my fingers crossed I'll get something. BTW I did not get the HR mail/note the OP was referring to.

They intentionally have this in writing in the policy “Generally, to be considered for an(VCIP) award, an employee must be with the company throughout the program year and remain with the company until the award is announced, usually in February after the close of the program year.” I am not a lawyer, but just because they’ve been paying it to people no longer employed in Feb does that make it a precedence argument?

Unless you have it in writing, it's hard to prove. I was let go in 2017 too but they said everything I was going to get was included in my package. And that includes a prorated, estimated amount for VCIP.

I’d start with a letter, sent registered mail, and keep the postage receipt. In the letter, explain the issue and demand what you were told you’d receive. Specify the amount of time you’ll wait for a reply before consulting with an attorney. Give them them that time, and if you don’t get a response, follow through. Good luck.
