Thread regarding ITT Educational Services Inc. layoffs

COBRA

So I just called the number ITT provided for COBRA, Chad Snyder. Surprise, ITT has not informed them yet about what they will be filing, so we are NOT eligible for COBRA. ITT has 30 days to inform them however, ITT did not inform us of this. Essentially, we have no insurance unless we go elsewhere to purchase.

Just got off the phone with Chard Snyder, for the second time, ITT still has not contacted them. The representative did take my email address and indicated they would notify me of any changes. I appreciated Post ID: @JgCxfDl-dtm, it was informative and confirmed what the Chard Snyder rep told me. Does anyone know if we can file a class action suit against ITT/ESI?

Isn't COBRA like unemployment? COBRA doesn't really have anything to do with ITT being responsible employer, does it? Isn't it designed to cover, among other things, actions like this by irresponsible employers? Yes it will be expensive though!

The Consolidated Omnibus Budget Reconciliation Act (COBRA) gives workers and their families who lose their health benefits the right to choose to continue group health benefits provided by their group health plan for limited periods of time under certain circumstances such as voluntary or involuntary job loss, reduction in the hours worked, transition between jobs, death, divorce, and other life events. Qualified individuals may be required to pay the entire premium for coverage up to 102 percent of the cost to the plan.

COBRA generally requires that group health plans sponsored by employers with 20 or more employees in the prior year offer employees and their families the opportunity for a temporary extension of health coverage (called continuation coverage) in certain instances where coverage under the plan would otherwise end.

COBRA outlines how employees and family members may elect continuation coverage. It also requires employers and plans to provide notice.

Stick to the facts.

ITT Educational Services (ESI) is not closed! It is the parent company of ITT-Technical Institutes, and it is still an ongoing business. They have not declared bankruptcy yet! They still operate Daniel Webster College and Benchmark Learning. They own the real estate of several campuses. They have cash on hand. They also have debts.

ESI decided to close the ITT-Technical Institutes, and they have sent termination notice to most employees, etc. Does not mean they have no money! Also doesn't mean they are going to willing give you any of it!

When you are terminated, you have certain rights under the law. COBRA is part of the law. Call your state attorney general. Find out what your rights are.

That COBRA post is half-right. Under COBRA you pay full cost, not the employee share after ITT pays its share.

If you are in a health emergency go to your nearest ER Hospital, by federal law they have to take care of you, they need to stabilize the patient; as for payment, well, your health is first.

In reference to rolling over or withdrawing your 401K, ITT still hasnt sent over any separation paperwork on us.

Does that matter? You can always do both, even 3 months ago when things were"noraml"

I contacted them as well. You can enroll in a medical plan through the market but it will not become effective until October 1st. This leaves us uninsured from now until then. Since ITT has 30 days by law to notify them of our employment status change it would seem that we are caught up in their red tape. I will say this. If something catastrophic were to happen between now and the 1st of October when a new plan would kick in you can always get COBRA, given the paperwork was processed properly and available, the coverage would be retroactive and claims could be reprocessed under the insurance plan. This doesn't do much for us now but a good piece of knowledge to have. I would also contact the state you live in as you may also qualify for some type of medical assistance where you wouldn't have to pay anything but make sure that you are checking to see if your doctors participate in that plan and if not just be willing to see another practitioner in the interim. This entire situation is so incredibly frustrating and handled so poorly. Bests of luck to you.

Even though, they have seen on the news we have ceased operations, ITT still needs to send over paperwork. The rep told me that it could be as soon as Friday (which was suppose to be our normal payday) or up to 30 days. I told them that ITT sent out the information to contact them when we got our termination email but Transamerica hasnt gotten anything on their end.
